| Some bits I would like to know:- If Hyperion wins the court case, what will happen?
If Amiga Inc wins the court case, what will happen?
( What will happen to the Amiga brand and Amiga OS 4 if each happened )
If Hyperion wins can OS4 be released for the Sam440?
What is the current status of the case, and what is the likely outcome?
Thanks, Alex. Last edited by DBAlex on 17-May-2008 at 09:59 PM.

| @DBAlex Well, if anybody "wins" anything you can't really force the other side to do anything for starters. Enforcement is your problem as a winner. It just gets worse from there. _________________ ExecSG Team Lead |

They will be able to continue to develop and market Amiga OS 4 (No other version) until they finaly fold in the inevitable conclusion of such a limited licence.

Hyperion will have to pay all the devs for all the code rights it handed out willy-nilly in an effort to get OS4 released before the court case so that it can provide Amiga with all the source code for the OS - thereby causing Hyperion to fold through bankrupcy.
Amiga will try to sell limited numbers of OS4 but will fail because all those with an interest in OS4 with feel betrayed and boycot the product causing the end of the Amiga desktop as a viable product. Amiga will continue for a few more years with Amiga Anywhere until it is bought out by Microsoft (because the legal issues have been resolved, Amigas sale becomes valid again) and eventualy the Amiga name is dropped from the product.

Hyperion have never had any claim to the brand, the licence to develop OS4 is very specific asto what Hyperion have access to. (OS4 only) Regardless of outcome of the trial, all other rights belong to Amiga.

Not under the terms of the contracts presented to the court as written. The licence permits Hyperion to make versions for the AmigaOne under production by Eyetech. The judge may rule this is too restrictive given Eyetechs demise and the OS's suitability to work on other hardware.

The same place as it was 5 years ago and the likely outcome regardless of ruling is the demise of Hyperion and the slow fade to grey of Amiga.
Note: This conclusion was based on what it says on the wikipedia page I was able to recover from leaked wi-fi transmition signals I recieved while arriving on this world in the year 2130. Because of the high levels of nuclear fallout, it is possible the remains of the interweb became corrupt or that the standards of the wikipedia are not as well maintained in the post apocalyptic world. One thing was abuntantly clear however, Hyperion will fold._________________ "Anyone with a modicum of reasonableness may realize that it is like comparing the ride in the world to descend the stairs to catch the milk in the house."
