| If I'm not wrong today is the end of the 10 days for Hyperion to respond to the Court's case. Right? |

I wonder whenever that makes it online. I think Hyperion is in big legal trouble so their response will be an interesting read.. _________________

I think Amiga Inc, are trying to wriggle out of their contractual obligations, just as the product is ready to ship, and are screwing Hyperion.

Let's not exaggerate. With Amiga Inc having broken the contract under which Hyperion has access to their IP, it is a matter of contention. Both parties are at fault in different respects. Not really familiar with how this works in the US, but I'm sure they will negotiate a deal.
Look at the performance of Amiga Inc against Garry Hare. There too they had arguments that looked solid until the surrounding facts were known. _________________ You know when you've been JackAttacked! |

Three possibilities. Either wait until Rich Woods or somebody else uploads them, try to figure out how to register with PACER yourself, or wait until the docs appear on this website.
T_Bone posted on moobunny that he has a PACER account, so maybe also he can help.Last edited by hatschi on 09-May-2007 at 12:00 PM.

Ah, let us lawyers, judge and jury then wait until the contents are presented to us before we jump to false conclusions. We *must* at all cost prevent giving the pretence of looking biased in this case!
So, let's bide our time.

Are there any other dates to keep track on? It would be nice to know if this mess could be cleared up before autum.

No, the document has been inserted on 4 may 2007 as you read in the header....
Check on the third page "2 mei 2007" (2 may 2007 in Nederland...).

Sorry, obviously I was looking at the wrong file. The file you and AmigaBlitter are referring to is accessible since friday, so while newer than the documents filed by Amiga Inc., it's not one of the latest docs either.
The newer ones seem to range from number 12-15. Last edited by hatschi on 09-May-2007 at 12:59 PM.

Interesting but not still public documents, I think...

They are publically available in a sense that you need to register with PACER before viewing/downloading them. I just had a look and it doesn't seem to require any rocket science, just a valid credit card. For each page, you are billed $0.08.
Justia OTOH is just a company that is focused on making legal information easily available, so basically they will have to download it through PACER as well.

| Looks like Hyperion has an airtight defense!
14 Filed & Entered: 05/08/2007 Declaration Docket Text: DECLARATION of William A. Kinsel filed by Defendant Hyperion VOF re [6] MOTION to Expedite Discovery (Kinsel, William)
"My investigation to date indicates that the pleadings were served on Hyperion in English, rather than one of the official languages of Denmark [???], namely Dutch French and German."

Jorkany is just reprinting what the Belgians are saying in there defense. Not sure why it matters to Ben and the crew, but the documents were not provided in one of the official languages of Denmark!!! AI is giong to lose now,. i'm going to help the Hyperion lawyer by telling him that none of the contracts were written in an official language of Denmark either, that could be another important point he could bring out. The judge in the case will also not be speaking one of the offical languages of Denmark. Man this is fun. We should do it more often :). -Tig
