yea WITH a warrant. however they are reading email and can tap into this without a warrant. a violation ot amendment 4 however nobody is making a big stink about this tho. instead opinion is oh well i don't care.

also the government privacy issues while scary is secondary to the fact that this info can and probably will be shared with private firms. some of whom sell info to the government without your knowledge. if i have control over who gets the info i wouldn't be as concerned. Examples, opt in for a Nielson type tracking of programming, opt in for targeted ads, opt out for all data shares. etc If you have no choice or can't trust the company will keep your info secret or will not keep info permanently is a big red flag of don't go there.

Privacy is an important consideration. If you have a smartphone or tablet then many of these apps have access to similar types of data about your life. I suspect Microsoft won't be much different then those apps in the handling of personal data.

Microsoft does have more explaining about privacy. They have 6 months or so to address the question. Here's a recent statement
"We know our customers want and expect strong privacy protections to be built into our products, devices and services, and for companies to be responsible stewards of their data. Microsoft has more than ten years of experience making privacy a top priority. Kinect for Xbox 360 was designed and built with strong privacy protections in place and the new Kinect will continue this commitment.

We are designing the new Kinect with simple, easy methods to customize privacy settings and provide clear notifications and meaningful privacy choices for how data will be used, stored and shared. We remain fully committed to addressing our customers' privacy questions in greater detail in the coming weeks.”
Sounds to me this will be similar to the warnings Apps provide on other devices.

I'm sure Nintendo and Sony are watching this closely. Both have talked about biometrics in their systems but Microsoft is first to the table there.

I suspect I'll have both Xbox One and PS4. Though we'll see what E3 brings in a couple of weeks.

I think the simple answer here is that if people are that concerned about their pivacy then they simply won't buy it. Google uses data analytics in their products in order to tailor ads to each person. It's in their TOS that they will be doing this. So the choice, again, is there to either continue using it or not.
