If there was any actual hope of winning a court case againist AROS, MorphOS, WinUAE, minimig etc. we would have seen that happen.

Instead we got loads of FUDtalk about legality of various solutions (Hey, that's free!)

Been using MorphOS since 0.3 (I think?), and meant to try AROS some day, just don't have enough free time anymore...

If Hyperion wins, maybe now Amiga OS 4 will get a chance of a x86 release
If Hyperion loses, they could open source it! A pipe dream I know.

Think I'll stick to the only sane Amiga solution, AROS. It's so close these days, just needs YAM and a browser! Installs beautifully on a dedicated box. Everyone would do they saves a favour, in supporting something created by the community for the community.

So let's see if I've got the sequence of events right:
- 2003 A Inc. claim they used the buyback clause but Hyperion refused to hand over the source code
- December 2006, three years later, the license agreement with Hyperion & Eyetech is terminated
- April 2007, four months later, A inc. sue Hyperion for copyright violation

Why did the termination of license take three years? The termination of contract in december means that A Inc. aren't entitled to anything developed beyond that date. The court case probably relates to Hyperion forging ahead with plans to sell AmigaOS for classic machines with A-Cube. I also see that they've chosen trial by jury, no doubt to leverage the fact that they're an American company and the defendant isn't.

Do A Inc. not realise how pathetic this looks? Legal actions have been a major reason why it's taken so long for a new AmigaOS to be developed in the first place.

There is only one action that would satisfy me: Amiga Inc. and Hyperion settle out of court, and get to work selling the new OS.
