Apple could like that they use their "spaces" icon for "workspaces". In germany apple has sued a coffee/tea-shop which was called Apfelkind, because they had a apple on their cups but hey apfelkind has won because it wasn't too similar.

It is never wise to sue any Linux distro ... Linux people have a
tendency to band together when the lawsuits come and they
make so much publicity about it that nobody even bothers to
sue them ... Even Apple and Microsoft see them as a wasp
nest and prefer not to touch them ...

So many boing ball logo changes that it's hurting my eyes. The one I liked the best was the one just before the current one.

@DiscreetFX

I wouldn't call them Boing Ball (R) ;)

I like red transparent sphere best as the new logo ...
But I guess the man can choose logo for his own
distro ...

Ehem yes, thats because I am member of OIN too but OS4 guys use "images"/"icons" this is a different matter. And as US citizen I would piss my pants now.

What you mean are "technologies" and UI stuff.

I assume they don't even know that those Icons are from Apple.

@phoenixkonsole

US law system is different than any country in Europe and in
every country it's always what judge thinks in the sentence
that is legally binding ... And icons and logo can be removed
if anyone with a legal claim asks politely

I see you understand trademark problems
They are even bigger and nastier in the US but strangely
enough Microsoft and Apple , both being US companies ,
try to avoid to sue US citizens ... Bad publicity ...

Sorry but if apple would allow even OS4 guys to use one of their Icons without sending a Mail would mean that they loose their rights on it. Not suing, means accepting. So if apples get a info about this they will for sure contact the guy who handels the website. Or at least forces the hosting servive to remove the page until things are cleard.

This fact forces companies to even shut down even small fishies websites just because of this.
It may not go to the court, agreed. But the bad PR wouldn't be for Apple it would be for the moron who copies others work.... which brings us somehow back to topic.

True ... So all they have to do is send a polite e-mail ...

Main difference between continental laws and US common law legal
system is that in US judge can "create" law in their sentence ...
So if Apple (R) sues and looses it risks to never win the same
type of case , or any other company for that matter ...

I think "moron" has at least a more "moron" lawyer than Apple has.
Or a smaller ammount of "moron" lawers... even if "moron" has a good insurance.

Whatever all the discussions make me tired and the fact that inteligent people spend time to discuss this is more than pitty. So I think it is time to stop it now.

looks like distrowatch lists os4 linux pagehits already on position 10:
http://distrowatch.com/dwres.php?resource=popularity
this is quite a steep progress, soon it will drive mint from the top;) and all apparently thank to amiga controverse. has not been a bad coup at least in this respect. apparently either this is some sort of scam, or there is still a considerable number of amiga lurkers checking the page every day, namely some 700..

i think i recall mason saying that his icon stuff is actually based on some linux icon set with modifications to adopt to amiga and derivatives, then this might be not a "set that looks a lot like masons" but actually the original set he based his work on. of course it is just a guess, feel free to correct me if im wrong.

That's bullshit! The AmigaOS 4 icons are *NOT* based on any other work and accusing me to use other people work is outrageous!

The real story behind this Linux set is quite the opposite: This guy calling himself "lordvecna" ripped the original OS4 icons and put them on gnome-look.org licensed under the GPL.

I kindly asked him to remove the archive but I never received an answer to my mails. The next step was to contact the staff of gnome-look.org and after some mails, where I provided some proves that I did this artwork, they removed the Icons at once. A view days later they were up again, but this time a simple notification was enough to get them removed.

After a view weeks he uploaded the actual set with badly altered Icons, but that is fine for me.

What is your comment on this wawa?
Worth an excuse?

You should be more carefully with statements like this. Worst case is when there is none to denie you statement and it is wrong.

I remember several other threads where you have give us misinformation.

It is not just a opinion, it is statement, unfortunately you have lots of that kind of "mistakes" in your history.

@thread

a few of the better nuggets from recent updates to os4online.com:

1. the OS has been renamed. again. to "OS/4" for some reason. apparently the slash makes all the difference.

2. roberto yesterday responded to the amiga-news.de coverage of his claimed, yet nonexistent, distribution agreement with cloanto. the post also makes new reference to a legal 'department' and a press 'officer' as well:

Quote:
There has been a faulty news report from a german news site who claims we do not have a license to sell this product. Well this is wrong. We are redistributing this product, we stand behind this product 100% just like the rest of our products and the first orders have already been shipped out to the people who have ordered them. According to our Press and Public relations officer, Dana, she has not received ANY requests or e-mail from this news site requesting information. So as far as we are concerned this is an unreliable and erroneous reporting. Any requests regarding public relations or press relations needs to be directed to Dana Dice, press@pc-opensystems.com. Any requests for licensing information or our partnerships needs to be directed to our legal department, and the best method of contact for that is legal@pc-opensystems.com and they will evaluate those requests. We strive to bring you top notch products. If we dont develop it than we go through outside vendors and we have established the partnerships and proper licensing to do this.

3. a quick update on their involvement with 'amiga' going forward:

Quote:
Amiga support. Why? Users have requested it. Since we reached out to the Amiga community its been a great building relationship and we do look forward to enhancing that relationship. Now, I am a realist and our core audience and community could really care less. Now, there are some people that do want it and we will include FS-UAE so customers can use their own ROMS and AmigaOS files. Now we will also include AROS as an alternative method for those who dont have ROMS and want to run classic Amiga apps and games. Amiga Forever we will not offer outside of our current bundle. Now, with all shipping systems we will offer the IcAROS operating system in a VM. IcAROS is a complete distribution of AROS and offers the best out of box AROS experience and Amiga like experience on x86 hardware. Performance is outstanding in VM's coupled with our hardware. Now, that will be a choice so if you want your hardware with that VM, just put it in your order notes. The AROS application in OS/4 OpenLinux will be removable for users who dont want it.

readers are welcome to come to their own conclusions.
