Yes we do. And its vice versa.

Our logo is 100% legal and doesn't confuse ANYONE to the quality of OS/4 and what they actually purchase. The AmigaOS market itself is so obscure, that if I used a checkmark it would not make a difference.

See, here he does treat us like ####. It is Boing Ball logo no matetr how much you change the colour. Why not using Penguin or any Linux related trademark? Its not that Amiga will be a driving force of OS/4 Linux or distinguishing feat.

Here you are lucky just because Amiga Inc is kind-of-dead company that doesn`t protect its trademarks, but you seem to be aware of possibility that it might lead to court.

f A-EON and Acube don't want to be involved in the PPC build then we will target the Apple G4 and G5 as well as IBM servers.

Trevor did express the interest, so you could ask for Nemo board there. Good there will be Amiga representative within the team, and not only Dana.

I don't see treating in any way despective in calling the AmigaOs platform obscure. It's the reality. Could you stop all the hating you are spreading?. it's getting tiresome like in your CUSA hate program.

i read with interest roberto's Q&A this morning. i find it rather interesting that he denigrates various other linux distributions with community-based support for power-based systems and declaring that his company 'fully' supports power -- without having actually done anything to date. i also found it interesting that he's hinting that his distro needs to bring in more money. not that i have a problem with this, per se, but i do wish we'd get rather less talk and more action. i think that would go a long way to dispell our suspicions about the nature of roberto's interest in the community over the past couple of months.

then on the subject of 'cease and desist' orders, roberto claimed he never received them and it was just a 'rumor' that he had. which is rather strange considering what he told us via IRC a couple of weeks back:

Quote:
[20:40:21] [eliyahu]	rjdohnert: it was. if it wasn't for the legal hogwash...
of course, that's a recurring theme in the post-
commodore amiga world.
[20:40:43] [Kelli217] One of the things that has made the community gunshy
[20:40:46] [rjdohnert] I NOTICED
[20:40:52] [number6] LOL
[20:41:03] [Ken] amikit is another
[20:41:17] [rjdohnert] I have gotten more C&D's and legal threats
[20:41:30] [PKodon] Yeah, the Amiga community has learned a lot from the
Windows/Mac world.
[20:41:40] [PKodon] Especially the value of lawyers.
[20:42:03] [eliyahu] yeah, but with all respect, taking someone's marks
without permission will usually result in that sort of
thing.
[20:42:10] [rjdohnert] Lawyers have a value?
[20:42:15] [eliyahu] of course its arguable that they even own them anymore....
[20:42:32] [PKodon] If you don't have what it takes to make money legitimately,
sue someone.
[20:42:32] [rjdohnert] Oh it had nothing to do with the naming
[20:42:42] [Kelli217] The C&Ds at least let you know who buried the bodies,
even if they don't tell you exactly where.
[20:42:42] [eliyahu] really?! do tell
[20:43:15] [rjdohnert] Lets see, I cant use the AROS, it contains AmigaOS 3.1
source code
[20:43:37] [eliyahu] wait -- what?! i think the AROS guys would heartily
disagree.
[20:43:39] [PKodon] Hi NomadOfNorad!
[20:43:50] [rjdohnert] I cant sell the vision 64 because its an AIO keyboard
too close to the Commodore 64
[20:44:12] [number6] now THAT'S funny!
[20:44:13] [eliyahu] that would either have to be from mcbill or barry's
lawyers.
[20:44:51] [rjdohnert] Its just crazy
[20:45:09] [rjdohnert] My lawyer charges me $75 bucks per response

hmmm. seems to me the 'rumors' were started by roberto himself. i'm sure it's not the case, but sometimes it seems that he can't keep his various stories straight. maybe he was just kidding around in IRC?

I seem to remember not too long ago the battle with C=USA and people on AO/AWN stating that Amiga Inc's boing ball trademark was defunct and anyone could be using it, not just those who were licensed under Amiga Inc. Guess they were right and their wishes have been heard and used by someone else. Ah, karma in action.

From your irc quote:

Quote:

You claim he said this today:

Quote:
then on the subject of 'cease and desist' orders, roberto claimed he never received them

What he actually posted:

Quote:
I also want to clarify something. It has come to my attention that I supposedly got 2 cease and desists orders from Amiga Inc. regarding our logo choice. Those are fabrications. I have gotten NO cease and desists from Amiga Inc.

Does that not read "from Amiga Inc."?

P.S. The AW page layout is a mess. You need to break LONG quotes from irc into shorter lines because they do NOT wrap around.
*Thanks for fixing it*. Browser and screen resolution do make a difference on what one sees. Heh.

No, Roberto is not yet there, but even having confusing and obscure market doesn`t entitle anyone rights to slightly alter its logo and go with it. Counting exactly for example that checkmark is licences to CUSA that cannot defend it.

Following that logic, as soon as OS/4 project fails I or you could similarly abused trademarks as we like it.

Not being illegal yet, does not mean it is not immoral.

Especially if legal advisors told him its best not to rename distro to Amiga Linux I don`t see how visual logo makes a difference. And he used to have nice PC Linux before.

And yes I did have similar opinion of CUSA`s legal ability to market "Commodore"
"Amiga" as they like it. But this is now exploitation of legally challenging situation.

Quote:
ah. quite so. well spotted. i missed the nuance there. thanks for the correction.

So there must be someone else defending legally Amiga? (I assume result was going back from Amiga OpenLinux to OS/4 OpenLinux)

sorry about that. i've edited it so that no line is more than 80 characters long. hopefully that cleans up the layout a bit.

Can it be that mainly only AmigaOS fans are so angry about it because they think only their choice deserves it to be called "Amiga"? As far as I can see the reactions no angry reactions in AROS camp, MorphOS and even the 68k community. If they violate any rights or trademarks the responsible persons that own this rights or trademarks should think about it and take legal actions. It is not my problem, I do not own it and are not paid for it. They have now given up trying to use "Amiga" for their distribution. If it really was the best idea can be discussed but they are now doing what is realistic. And that X1000 (and successors) is obscure in todays world where you get cheaper and better hardware at every corner (viewed from outside) might not be the best phrase when you want to win the AmigaOS fans but it is honest.

Angry reactions to who? what? You mean the OP?

Read the reaction. You decide.

Anyone would be forgiven for thinking the OP's account was created just so you could come in a spam our forum with ads for your ripoff tripe.
CUSA mk2 with even less to offer, in fact even Merlancia was a better class of swindle.

I "guess"? that could be called a compliment and a warm reception?

Name is important. Only insiders in our community know these camps have anything common with Amiga. Say AmigaOne/AmigaOS and Amiga heritage is clear to most former Amiga users.

Seems like a good enough topic as any; which camp is the most angry, find a scale and do some
graphs.

Should keep this thread going for another 20 pages.

@Overflow

Very funny...

it was not meant that way to go on with a senseless discussions. But the comments partly start to nerve. We are all Amigians and only one camp seems to feel itself expecially "attacked" or annoyed by this. They thought about using the trademark in a way and got bad reactions and dropped it. Now next discussion if their new logo is too similar. How about recommending them to drop logo and all related things and just concentrate on AROS? Would be a economic better way than investing in PPC. What do you think?
