Legaly, they are bankrupt - now. But there is still possibility they succeed in overturning that ruling.

Hyperion owns the distribution rights (for lack of a better word, IANAL) to AmigaOS 4 - they are the only party who can distribute a product with that name. Hyperion does not own any code, they only have distribution rights.

As for the Frieden brothers - they were only independent contractors, they were never part of Hyperion. Thomas is allegedly gone for good (working for a big Linux company these days), while Hans-Jörg was supposedly hired by Trevor to finish the promised W3D drivers. But given the lack of progress on that front, he doesn't seem to be all that active.

I can't believe people in this thread are saying things like "Ben Hermans cleared that up" with a straight face. If you think you owe him some loyalty because of his involvement with AmigaOS - go ask Trevor, Matthew or any OS4 developer of your choice in private for his opinion on this matter.

The one important bit in his posting seems to be this one:

To sell Amiga IP and distribution rights, the buyer needs Amiga Inc's approval? If so, McEwen is probably going to make life difficult for anyone who tries that - making it unlikely it will ever happen.

Question now is - if Hyperion goes out of business, where does that leaves A-eon with their hardware investment? MorphOS Team is not willung to port to expensive HW, leaving only AROS as a viable alternative.

And all OS4 users, who bought pretty expensive HW, might be left with a very expensive doorstop.

Don´t underestimate thirst for cash of Bill McEwen...

It would be logical to buy Hyperion with all rights covered by Settlement Agreement.

No, developement continues, Hyperion has not been wound up and continues trading.

No idea of the fine details of that, but I think Hyperion can sublicense, but that not relvalant to this case.

Extreme logic failure, the OS doesn't stop working just becuase the company develeoping goes bankrupt, did all your a500s and a1200 suddently explode in the 1990s?

Anyway moot point because as I said developement continues and Hyperion continue to trade, you can still buy FE.

You might fix that line..

If Hyperion goes bust then neither do I see it as the end of AmigaOS, not with a community like this and companies like ACube and A-EON.

Based on comments made by A-EON he is working for them on two projects (LibreOffice and GDB), maybe they count as a big linux company? Or maybe CGutJahr is spreading unsubstaitated and at best incomplete FUD.

That was many years ago so I don't have the link, sorry. IIRC there would be a way for compatibility as well. For which version of AOS I'm unsure, it might be for AOS 5 like you wrote. Some future version anyway and you're right, it's probably not for AOS 4.2.

Ah, but A500 and A1000 were fully supported, while OS4 users who bought X1000 were promised SMP, 3D and other things which, to this day, are still not done.

So what would you suggest to X1000 owners, who spent 3000$ on an already obsolete computer, to do if Hyperion goes under and OS4 development stops?

So I just had a bet with myself that it would be 9 pages long by now. Looks like I lost.

I'm not surprsed to see this thread take off, but I was a bit shocked after reading what's happened on page three that it still kept going.

Keep the momentum going.

To clarify my earlier remark about Arix, it is a kernel, not a complete operating system. Aros seems to have an experimental design based on it. OS 5 could also.

I find it offensive that you are still using the "amiga-news" avatar as if you are a real "journalist".

About 90% of your claims are so blatantly wrong that you obviously did zero fact checking.

Thomas Frieden's main activities for the past 6 months were working on the AmigaOS 4.x port to the Cyus platform, porting LibreOffice (1 day per week) to AmigaOS and general ExecSG kernel work. All paid for either by Hyperion or by A-EON (LibreOffice). Nothing new there. Linux company?

Hans-Joerg has been working mainly on a port of the most recent version of Gallium and on the Cyrus firmware.

Buy why bother about the facts? It is disgrace that you are part of a news-site, you run some kind of silly hate campaign based on your non existing insight in basic facts which do not matter to you.

I see you still try to keep up a facade of a company account. Nobody's fooled. But even so as you are posting _personal_ opinions using this "shared" account the honest thing to do is to sign your posts.

But we all know you aren't a honest person.

The person you are replying to have a much better record of working as a (honest) journalist than you do - nobody remembering your dishonest drivel, misdirections and outright lies over the years would value your posts worthy of even 2 picocents.
