Thanks for that information.

For those that read up on all the finer details, twists and turns of AOS x;

What are the implications with regards to the future of AOS 4 if Hyperion stays bankrupt,
AEON obviously "needs" AOS 4 for their PPC platform (Linux is just one of the options being added, even tho it got better features).

I like Colanto as a Company and the products they produce. I also feel that OS3.1-3.9 is the best Amiga Workbenchs ever.

To be honest, i never liked 3.9 too much, it looks like subpar work to me, in fact all my original Miggies are stuck at 3.1-3.5 and i don't plan to upgrade any of them. I use 3.9 on WinUAE only and not that much, also.

This is old news. I remember reading it at least one year ago, and by the document date it was first posted in June 2011:

If nobody noticed the news (or the copyright publications) 2011-2015, and nobody commented on it now, it seems the Amiga community is in a quite depressing state of affairs!

Why Acer? Gateway only retained the patents, which have now expired. Acer inherited nothing.

For the "vacuum cleaner" design, you would have to check what the contract says about ownership. The company who did that claimed they were never paid, but that by itself could be normal if the customer was under a bankruptcy/liquidation procedure. They ought to have followed the procedure with the liquidator, rather than just complain they were not paid.

Or in other words, define "case design". If it is copyrightable, it falls under copyrights (Cloanto). If it is something else (trademark? registered design? patent?), find the registration in the relevant database, and we will all know more.

Minor point concerning no comments on Amiganews.de, the source:

Click German and you'll see some comments.
Everything requires translation and comments in english on the site have always been few and far between.

That really comes down to the Gateway wiki statement about Amiga Inc. being a licensee.

The statement looks more accurate if you replace the somewhat vague "Amiga intellectual property" with "patents". For the rest (trademarks, copyrights) the Amiga-News article linked to official records.

John Spelich's own words (in the article quoted by you) can be read to support this: Gateway sold all assets to Amiga, except for the "Amiga patents" (which were licensed to Amiga) and "the technology that's been worked on while it was under Gateway's auspices" (i.e. nothing of relevance to the Amiga community).

The Gateway wiki currently reads:

Perhaps this will help, regarding "license".

Acer own the Amiga Name and IP, KMOS only has a license to use it!

Note the discussion about rights to revoke.

I'm not arguing the point even though the same discussion has gone on in the forums for years. I'm just providing an alternative explanation.

Also note that the wiki gets continually, erm...edited.

Then they are completely screwed. If this article is correct then license for os4 is not transferable to a third party unless they get the consent from amiga inc, which of course is not likely to happen.

How would this help?

The amiga.org thread contains no factual information.

The thread subject is plain wrong. Lookups at uspto.gov and copyright.gov are sufficient to prove how non-patent assets were transferred (they changed hands), not licensed.

The only non-sale license, as supported by your citation, was about patents, and these expired years ago. So what is the purpose of a debate about revoking these?

Dude, lose the chip.
Some of us don't really care enough to look this stuff up. Number6 always posts from a perspective of objectivity. It's interesting to read sometimes (in a "I couldn't care either way" sort of way).

I have to wonder what *your* motivation is here. Four posts, all of them proclaiming how smart you are, then you have the audacity to question a long time members agenda (who again, has always been objective, just posting things as he comes across them). Also, "interesting" how you just happen to have all this at hand, and have posted only on this subject.

Yes, as Im sure you're thinking now, the above is ridiculous.

Cant say aria got a chip to loose. Like you, I do not actually care enough to look these things up.
That said, I dont see a reason to call out someone that actually takes the time to do so, even if that ends up contradicting what "long time members" says.
I rather welcome additional information which will make people take a second look.

Unlike many other comments on this forum (mine included), atleast Number 6 and aria conveyes information. Add it up and it will probarly enlighten us all at the end of it.

Sure, extra/alternative info. is always welcome. The tone however is unnecessary.
Me pointing out Number6 being a long time member was just to point out how silly it was to suggest a motivation. Doesn't take much research to find these answers/information. Ironically the same person appears to have some attitude towards people finding correct information

If it's simply a case of me misconstruing intent because of mediums lack of tone&infliction, then I do apologize, but only he knows that for sure.
