But they have everything that is real, true, original. Not reversed-engineered. As well as documentation, books, old media like commercials, etc. These things are valuable to retro enthusiasts. Doesn't matter if it's computers, automobiles, old motorcycles, airplanes, boats, whatever. The real stuff always scores highest!



If you don't want the real, if you merely want to play an Amiga game, then you are perhaps not in the custom segment anyway...

One could hope that the "real" could one day be used
to advantage of anything Amiga related instead for lawsuits
and capital investments.Aros,AOS,Morphos,(Win)Uae,etc...

Hyperion and Individual Computers Sign License Agreement

That was 2013.

Since then Cloanto asserted more of their rights.

Cloanto confirms transfers of Commodore/Amiga copyrights

That was 2015.

Now we have the new statement mentioned in this thread.

Trevor's blog "Michael Battilana of Cloanto flexing his muscle?". Heh. Dual meaning I should say.

You are ignoring half the facts on the table and then come to the most paranoid conclusion available.

1. "Commodore Ltd." announced a phone featuring emulators for various Commodore machines, and Cloanto is reacting to that - they're referring to "PET, C64 and Amiga computers" throughout the entire PR.

2. Yes, there is an AROS replacement ROM, and that's a nice achievement. But if you had actually tested it, you'd know It is not suitable as a drop-in replacement for retro gaming purposes.

3. IIRC, Cloanto is actually shipping AROS with Amiga Forever.

I don't understand all this talk about "holding the brand".

Amiga Inc. did not license the brand for over a decade, and only when their impending court case demanded they show some usage.

C=Holdings B.V. has only had legal rights for over a year. Why are they the source of people's ire compared to Amiga Inc. I wonder?

Anyway, they had and may currently have a relationship with CUSA, that's obvious. I'm sure one or the other can clarify the current status. Heh.

It doesn't work like that , trademark in question (you provided) :

So you can say that lately they made computers and computer
casings with CUSA sublicense deal.What about the rest ?

They need to make ALL of those thing in regular time periods
to keep registration alive and in this form.Apart from that they
are not registered for making smartphones so if anyone would
ask them for license to make smartphones they couldn't give it
even if they wanted.They could take money for nothing though.

Now they are talking about company(ies) names and logos but
it's not true that CBM needs written permission , in absence of
that they can make public disclaimer ("we have nothing to do with
Commodore Corp.) which they did.This is to avoid confusion
between companies so they don't cause damage to one another.

EDIT : Although trademark changed owner , new owner can't re-
start the deadlines.If trademark wasn't used for say 7 years and
someone else buys it is still not used for 7 years.

There is mediation procedure involved in trademark opposition
in UK (9 moths , can be extended to 18).Not mandatory though ...

No it seems that site was reworked , I can only
assume without SOURCE that they got few letters
from Commodore Corp. saying something like "you
will bear responsibility for selling / retailing goods
with our logo without our permission" or something
like that.

Other option is that you have to register , they had a
lots of other products as well.

Agree.

at the time I made this post

The CommodoreSmart site had removed everything as well, and returned to a mere "contact" page, which is similar to what we currently see at Amibyte. Since then the text and imagery on CommodoreSmart site has returned (changed).

So it is possible that the Amibyte pages are being reworked, as opposed to being challenged. We'll see...

I think they said that shipping starts now but I didn't know
they took pre-orders and waited 2 months.Might suggest
that it takes 2 months to build the phones (evil perspective)
or that it takes 2 month for Frodo and UAE4Droid to be done
right (optimistic perspective).
