@OlafS25

As I read it the confusion for AmigaOS and AmigaOne is with the Amiga trademark of Amiga Inc. even though that tradmark seems likely to have expired and been cancelled on January 17th (unless they did renew it) apparently it can take months for an expired mark be updated from being "live" in various databases. However with Cloanto trying to get the Amiga trademark Hyperion have been advised that Cloanto also have prior claim to the similar mark Amiga in Application Serial No. 87287078.

Citigroup are only cited in case history of similar disputes, nothing specific to the Amiga mark.

I've referred to the courtesy renewal notice by that term before.

I'll include the exact content to eliminate any misunderstanding regarding dates and actions required:

USPTO Courtesy reminder

Adding the document concerning opposition period of the Cloanto Amiga trademark, previously referred to:

TRADEMARK OFFICIAL GAZETTE PUBLICATION CONFIRMATION

@Jose

> Who cares, the Amiga name as trademark has little value anyway and people noadays are smart enough to find out what is what (I think...:))

That makes me wonder what the guys behind this company was thinking about
www.amigasystem.no
Is that name even legal to use like they do, unless they actually have permission from Amiga Inc?

@amyren

Almost certainly it's legal as it's in a completely different area of business to the Amiga we are interested in. There are lots of companies using Amiga for products in different sectors.

Examples

@thread

Perhaps I misunderstand, but by reading quotes from the principals about who licenses what trademark to whom, it seems this is of importance, whilst others here seem to think the trademarks are of no/little importance.

Here are Trevor Dickinson's "understandings" from various points in time:

Quote:
Therefore the AmigaOS, AmigaOne etc names and trademarks although licensed from AI effectively belong to Hyperion.

Source

Quote:
However, I believe that AmigaKit are licensed by Hyperion Entertainment to create AmigaOS, AmigaOne, Boing Ball, etc branded goods and memorabilia.

Source

Quote:
It provides revenue for the Amiga retailers and in turn provides much need funds for the continued development of hardware and software.

Source

These statements are made post-lawsuit btw. Would not ownership of these trademarks affect licensing agreements?

@number6

I know in german if parts of agreement are illegal (f.e. laws changed) the rest stays valid. I assume that this is similar in USA, even if one part of agreement is broken (trademarks no longer reserved) the rest (license for using sources) is still active. That basically would mean amigaos could still be sold but not under the name and the hardware could no longer be called AmigaOne. Would be interesting if my interpretation would be valid

@TRIPOS

Sorry. I'm not sure what you're asking.

My post above is about Hyperion licensing TO others only and if/how trademark changes would affect that.

Technically, I suppose we're talking sub-licensing (Hyperion to others).

When will this circus of IP/Licensing/Patents/Copyrights end??

Is it a weird coincidence that the Ringling Brothers circus has its last performances this month?

Looks like Cloanto is trying to register also "WORKBENCH" in EU right now (examination in progress from 13.04.2017).
