I've taken quotes from the following document:
http://merlancia.us/amiga-hyperion/35-4decmcewenexhibit3show_case_doc.pdf
.. but you might want to start reading from the beginning, as there are several new documents released on the same date (26-May-2007). They're available here: http://merlancia.us/amiga-hyperion/

Page 4:
Quote:
Bill McEwen says: First I wanted to let you know that I am still trying very hard to get this Amiga Hyperion thing fixed. We have offered 2 million to Hyperion for OS4 and the assumption of all debts and contracts. I hope that they will accept so that I can get you guys taken care of and part of the team :), we have several opportunities before us, and I would really like the two of you to be part of the team as we move forward. (hardware discussion snipped, because its irrelevant to the point of my post here)

Page 6:
Quote:
Bill McEwen says: I sure hope that with the 2 million dollar offer, and our taking over the contracts we can get this moving. Have you been talked to at all about what is happening, I just want to get us all on the same team. Carl, RJ, Dale and the two of you would make a killer OS team.

Page 7:
Quote:
Bill McEwen says: Well as mentioned we have offered 2 million to Hyperion, which is double what they asked for

I'm wondering what the stumbling block with this offer was. There must be more to the story. Maybe we'll find out in a few weeks.

Oh now this just ain't right. Read the transcript, guys. If McEwen is even half way telling the truth in this conversation with the Brothers Frieden, Hyperion needs to give it up.

Ridiculous.

@A3K

Hyperion and/or Amiga Inc must have had conditions to go with their figures.

Wow, amazing if true. I wonder if there are docs to back up those statements? I'm off to do some reading.

Only just had time to scan these documents quickly, will give them a proper read after work. Mini-laptop, Sony approaching Amiga about OS4? (RJ Mical works for Sony now). I can barely believe what I'm reading...

Same here. I'm still trying to make some sense out of the time lines involved in the exhibit pages, but there are some big names being thrown around in there. I can't tell yet how recent or old these conversations are. Got to get some sleep for now. Maybe by tomorrow some one will have this sorted and post a short review.

Well for all the naysayers, there is clear evidence that Amiga Inc plan to support the desktop Amiga (Including a laptop) as part of their plans.

Interesting read. Very interesting.

hello,

IMHO, hyperion MUST continue the AOS4 development because they know all about the AOS4 and the amiga feeling, use and pleasure to use AOS all day.

It's verry hard to understand what happened behind and hard to accept that now AINC is full of money and the actual situation will kill the old amiga community. Amiga community now just want to see the results or progress with picture, all announce is just annouces and amiga had 10 yers of announces with nothing behind him.

Ainc full of money, I would like to see their office, employers with picture inside one or more interview. Why Ainc so secret with themselve ????

... interesting.

I had a very fast read of the documentes you linked to, there is a chat between the guys from Italy and Bill where on a certain point the italians say to have ported OS4 to the Mac mini, the so called Moana project.

November 9th. 2006. The transcripts were entered as evidence by McEwan and the date is on page 8 of his reply to Hyperion (latest).

Perhaps, but it doesn't look like they were planning to use OS4. Amiga Inc is treating Hyperion as a competitor and not a licensee. In 33amigareplymotioninjunctionshow_case_doc.pdf, it says "Hyperion's attempt to usurp and obtain a 'first mover' position in one or more markets and platforms reserved for Amiga constitutes actual irreparable harm as well". If Hyperion were Amiga Inc's licensee, then Hyperion entering a market means that Amiga Inc enters that market as well. However, Amiga Inc sounds like they did not want Hyperion entering the market in the first place.

@CodeSmith

It IS Amiga's marketplace. Licences are given out by Amiga not Hyperion. When Hyperion started making deals on behalf of the trademark they stepped on Amigas toes. I think that is what he refers to, rather than them competing on OS's.

2 Milion for AMIGA OS is nothing... an Operating System worth much more.. and AMIGA OS worth even more for all the efforts put inside by all the AMIGA OS 4.0 TEAM..

I can only say that I really hate companies. Especially the ones that have investors. It seems there is always something going on when you have investors, shares and stake holders.

It's pretty obvious the state where Amiga is in is because for the past 10 years there has only been stubborn people involved in everything. Now this. So we are going nowhere again this year either. With all this info being thrown around I don't see a court doing any kind of verdict soon.

What I don't see in all these court proceedings is the name Gateway 2000. Don't they still own a lot of stuff? Aren't they still the MAIN owners of Amiga technology? Didn't they license stuff to Amiga Inc. in the first place?

Considering that Hyperion once signed a contract, agreeing to the amount of $25,000 as a reasonable amount for doing AmigaOS4.0, the $2 million offered in addition to that $25,000 should be plenty, don't you agree?

It's always interesting reading dialogs! It's like a novel

Anyway, I am really confused (once again). First I would like to know why the the minilaptop has only a 5'' LCD screen! Well, how "mini" would that be?

One thing that I liked was that Amiga did make an offer. Not an impressive one but still a very good one! And as McEwen states they doubled the offer from what Hyperion asked.

I didn't liked the part about the Friedens changing their mails to "amiga.com".

What's an "iMac Mini"? Something from MacRumors.com?

nubechecorre:
Considering there are about 1,000 Amiga users, 2 MUSD equals
to 2,000 USD/user. And that's a hell of a lot of money!

Now isn't that the Amiga myth of the decade? If that would've been the case, I'm quite sure Amiga Inc.'s enemies would've exposed that already. I don't know how many times this rumour has been dispelled now, yet someone seems to believe it anyway. Let's just face the fact that Amiga Inc. wouldn't have had much of a case to begin with if they didn't have the appropriate rights. But then Amiga Inc. wouldn't have had any rights to give to Hyperion either, now would they? So, that would leave both Amiga Inc. and Hyperion without the rights to develop and market AmigaOS4, something I believe that you don't want to be true either, right?
