Hi Jamie, I am new here and I had the chance to check out the DevKit you are developing; it's Awesome!
The reason i am exited about it is because the only complete softwares I wrote for the PC were done in Visaul Basic first and QT recently.
Your DevKit resembles those environments pretty well and I truly wish you complete it.
If they make a new bounty I will gladly donate

Yeah, simple as it's written!
Hyperion can use 3.1 source code in order to develop os4.x and beyond, i.e. they have no rights to sell 3.1. They have exclusive right meaning no other besides them can change the source code.
Cloanto can sell 3.1 but they cannot change it, just sell it as it is - a final product.

That's all they would need, but that's not how it's worded in the announcement at least. But then, we have not seen the actual agreement document, which may not have been quoted word-by-word anyway.

According to the terms of the license Hyperion Entertainment can market and distribute AmigaOS 3.1 in any form, through any medium etc.

There is no limitation to AmigaOS 4.x.

Hey all glad amiga survivor!

First, I must congratulate all Hyperion and Amiga developers to now can work on without the risk that it stops in one way or another.

For me it was not this a surprise. With a few adjustments here and there we are at square one again. So that Hyperion is the Amiga OS evolution from OS3.1 to OS4.0 and developing all versions of OS4.0.
What I do not know yet is if Amiga Inc. also continues to square one , namely producing cheap hardware OS4.x as it once claimed to be done next. I think Jamie Krueger suggests this also:
"I am very happy the development on AmigaOS can continue with this legal barrier finally removed, and I hope that new hardware deals can now become a reality as well. This settlement should have happened more than two years ago, but at least it finally has."
and
"Personally whatever they do support next I hope it will be powerful, reasonably priced and easily available worldwide."


At first I thought that the contract was due to Amiga Inc has a shortage of money but Jamie Krueger's remarks, that he had not yet decided to continue, probably means that the money was not critical to this Agreement.

What happens now?
- It is not impossible to Amiga Inc continues with its hardware, although it currently does not look like.
- It is not impossible that Hyperion and Amiga agreed that Hyperion develops OS for PPC and various dialects of it while Amiga Inc. develops OS for x86 and various dialects of it.
Amiga Inc's OS will be called something other than the Amiga OS. I guess the Amiga Workbench 5.0.
- When Amiga Inc is ready with what it now refers to 5.0 will also continue with AA2 while OS5.0.


One possibility is that the Amiga Inc would not longer have any currency flow, after Pentti passed away, and that they wrote all over the Hyperion to the saga would continue.
But Jamie Krueger's remarks and that not everything written above contradicts this.


Anyway, we begin to see an amusing development in which Hyperion and Amiga Inc co-operate to lift the phenomenon of "Amiga" to a new level.


For my part, I hope to avoid reading all these speculative harsh and ugly words and sentences on the participants in the process of lifting the "Amiga". Now let's all go the same direction!

I very much doubt that Amiga Inc wants to have *anything* to do with OS4 anymore. That means no OS4 hardware from them.

If AI still hopes to be a viable business (I have strong doubts) then they need to concentrate on whatever sellable products they have. That means AA2 or bust.

This opens a very interesting path to NatAmi developers...

EDIT: forgot about possible minimig bundle with OS, remember that acube also builds those, and they're improving the design with more ram as well.

As i see it, now Hyperion rightfully own ALL the rights to AmigaOS, they also decide the future of AmigaOS 5 as i take it, which is a very good thing.

If Amiga Inc simply want AmigaOS 5, then they have to ask Hyperion for a license, and
Hyperion won't be a fool to make a proper license agreement to make it very clear who is the full owner of all rights to AmigaOS and who has to ask for license...

I suppose that Hyperion Entertainment also fully support the AROS-project, and might help the team with further support where it's necessary. A good thing anyway.

I still think it would be a good idea to release at least 1.x roms for free (not the sources nor WB disks, just the ROM)...
