4 things made an Amiga:

A - High performance, unique custom hardware
B - Outstanding operating system and GUI (Workbench)
C - Exclusive/awesome games
D - Kick-ass user community

It wasn't until after the demise of Commodore (and Escom) in the Gateway years, that it's decided that point A is a dead end, due the way the industry evolved. Only since then, the Amiga is reduced to B, an Operating System. C and D are pretty much gone, obviously.

So this is why the whole "whatever runs AmigaOS4 is the true Amiga" is BS to me. Escom were the last to build Amiga computers.

There is no and there will be no x86 with the official Amiga Operating System unless Hyperion decide there will be. Is what I think you mean.

This may be valid for some - but for me the Amiga was never about games.
I have perhaps 10 games at most, while I have a whole desk full of serious applicatins (such as CAD, CAM, CNC, mathematics & engineering applications, graphic applications, animating software etc.) ...

Hyperion only owns a license, not the trademark. Therefore, x86 Amiga OS is not impossible because of Hyperion...

Amiga OS is rather unlikely to evolve any further then OS4 as there is no users. Even if you port it to x86, again, no users. So there's no point in any Amiga(like) OS on x86 currently. It doesn't pay of... user base is small, software base likewise. Who'd pay for a x86 OS4 when they can run Open source OS and software which is better and more up to date?

It's not as straightforward as you make out though.

Let's imagine you define Amigas more by the hardware. What happens when AROS is ported to 68k Amigas? That would mean AROS would run on 'real' Amigas, whereas the latest version of AmigaOS (4.1) would not.

How does this fit in with your definition of what makes an Amiga system?

That argument has been presented a million times and each time proved invalid.

Not true. I suggest you read the official announcement.

The second paragraph clear states that Hyperion is now the sole OWNER of the Amiga Operating System and Amiga Inc. is completely out the equation and is powerless.

The word 'license' is not mentioned once in the settlement.

Hardware doesn't make a Mac a Mac, hardware doesn't make a PC a PC, hardware doesn't make an Amiga an Amiga. Those ways of thinking died decades ago.

Yes its true Amiga did have some hardware features that made it unique at the time, but it was the underlying operating system that brought it altogether and made it work and that was the Amiga.

And once again AROS isn't the official Amiga Operating System therefore no point comparing that either.

Hyperion is the owner of the OS4.... that does not preclude a Amiga OSX on x86, done by someone else, if hyperion doesn't own the exclusive "Amiga OS"/"Amiga OS" license any more.

Only Amiga Inc own the rights on the Amiga OS and all of the variations, and Hyperion owns OS4(it's theri code, afterall)

Hyperion´s licence for AmigaOS is exclusive...

Amiga.Inc owns rights to the "Software" (AmigaOS 3.1 without name...), but cant´t use AmigaOS/Amiga OS/Amiga operating system names.

As far as I understood it, they are already produced.
All he needs to do is to glue the Commodore stickers on them.

And I bet that's all he's capable of - I doubt he has plans to start a x86 hardware production.

No, Amiga Inc. had it 'taken-away' from them and awarded to Hyperion.

No mention of license in the agreement, full ownership transferred to Hyperion. :)

Wait a sec... If somebody owns a "exclusive licence or rights", they cannot be the owners of the trademark. Why would anyone award themselves license or rights to use a trademark if they own it?

C=USA has exclusive right on the C= and Amiga trademark to use them on their AIO computers, that doesn't make them owners of the trademarks.

Ownership of the OS4, yes, not AmigaOS or Amiga OS... that's the exclusive license part.

I could be wrong, I'm no lawyer...

Yes. However, Hyperion claims that it also owns some of the licenced marks by its own right.

On point A, late 80s Intel 860 RISC CGPU says Hi i.e. the classic Amiga is not SGI.

The classic Amiga associated high performance at a value and affordable price.

Based on that, Amiga parties(i.e. Amiga Inc +...) still owns the Software(OS 3.1) and trademarks but are not allowed to use it as long as Hyperion is using them.

Amiga Inc and others granted Hyperion the exclusive (trandsferrable)rights on the Exclusive Licensed Marks(Amiga OS, AmigaOne and variations).
