@OlafS25

Maybe we should change Amiga in to Novia.

As we know Amiga now more then 25 years,
i think it is time to mary her.

I don't think someone with an Amiga license rebranding AROS as AmigaOS equals someone without an Amiga license using a name "OS4" that he already stated Hyperion has no issue with by itself. My crazy opinion is that he's testing for a pulse at Amiga Inc. and Reed Smith. Heh.

Regardless, from the standpoint of trivia, the CUSA announcement had about a 5 hour period before public response from Hyperion. This current statement has well exceeded that time frame regarding a public response.

No it is not that bad. You can licence Amiga name from Amiga.Inc, if you don´t use AmigaOS-like OS (eg. CommodoreUSA). Or you can licence AmigaOne name with AmigaOS from Hyperion (eg. Acube, A-Eon). Only if you want plain "Amiga" name (not only AmigaOne) with AmigaOS (or AmigaOS-like OS), you must contact both Amiga.Inc and Hyperion.

Amiga branded Linux distribution needs only blessing from Amiga.Inc.

We had this topic already with CUSA. A Debian distribution with Amiga wallpaper is still a Debian distribution. People are not stupid so "Amiga" only makes sense when the product is somehow related to what people can remember. Perhaps a game console that uses Linux in Background and starts Emulation to play 68k games could be legal (just a guess).

Similar solution is mentioned in the Settlement Agreement.

I can see the emails now.

Bill,

This is Ben can you afford to pay for the threatening letter I'm a bit strapped for cash. Besides if any devs heard I had the extra $20 to pay for they might be asking for pay.

Ben

Ben,
Sorry I just had to buy milk at the house I'm strapped too.
Bill

Bill,

hopefully we can outlast this one so they don't invalidate the wordmarks.
Ben

Ben,

Wordmarks? We still have those? I thought we lost them about the time we couldn't afford to pay for our domain.

As far as I know CUSA wanted to include original ROMs from amigaforever or ROM Replacements in their distribution so it seemed to be legal. But as I said it is becoming less and less important because most people today never heard of "Amiga" in their life. And in technical sense those copyrighted parts will be more and more replaced by opensource.

@RobertJDohnert

You could try Darren B. Cohen at Reed Smith I suppose.

Lawyers are known to always give honest answers. Heh.

To those who don't know, Darren is correspondent of AMIGA trademark for the only U.S. trademark pertinenet to a discussion in the U.S.
Serial #: 73571532 - still listed as active

You might enjoy this link too:

Pluritas

Mark Thomson was the one in charge of the account at Pluritas btw. Resolution of this was never posted publically, afaik.

I should probably mention that the poster speaking about Pluritas has claimed:
Quote:
Trademarks/Licensing etc is my field

He brought up an interesting point pertaining (my opinion) to why no one gets a response from Amiga Inc. on this topic:
Quote:
They would I am sure advise you if they have granted exclusive rights to someone else...

By not responding, they don't have to issue that "telling" response.

I think you would be surprised how many in the Amiga community have been pretty enthusiastic and supportive of the idea. Like I said, it was an Amiga community member who suggested it anyhow.

Im not trying to start a legal battle with anyone, nor am I special and just need attention, Im trying to get THEIR attention in a productive way,

That would be surprise. As I wrote, once you get proper licence, you have my full support (not that it means something ).
Beware, there are members of our community, who will hunt you for the rest of your life, if you break their dreams in any way.

@RobertJDohnert

Although I respected the down to earth response over OS4 Openlinux. The sudden change of naming convention for OS4 to Amiga and the use of the BoingBall logo slightly sickens me. It makes me think you planned this all along. Whats the point on using the Amiga name and BoingBall if it has not connection to AmigaInc or Hyperion. Just because someone supports an idea doesn't make it a perfect solution. I will repeat, this will just cause confusion.
