Wow, I didn't realize you had so many different hardware issues with your Sam. My OS 4 experience was a lot different than yours...when I got my AmigaOne in, I think 2003, I was thrilled just to be using Amiga OS again.....after 3 years of Windows crap OS. Plus it had a built-in high resolution graphics card, sound worked flawlessly, and Petunia allowed me to load and run most o f my old Amiga programs without having to load and configure UAE. This was infinitely better than Amiga OS3 and far more stable.
Sure, memory protection is a must nowadays but OS 3 didn't have it so I was used to running that way.
I`m just surprised at how bitter you seem to have become about Amiga OS4 since you sold your SAM. Your posts have gotten more critical, demeaning and pointless. Why do you hang around this forum? Really, is it just to bash and mock people because you didn't get the OS the way you wanted it to be?
I`m sorry you're SAM sucked. It was pretty bad that you got a machine with sound problems and other issues.....but why do you hang around here for years now just to bash and vent? Why stew in a pool of bitterness, my friend? Go buy and enjoy Morph OS, AROS, ios, whatever..... and enjoy it! If you wanted Amiga OS4 to succeed, you could have used your programming talents to help make some new and better programs for it. You had a chance to make a difference.
Why live in a world of "if only"'..... if only Commodore had marketed the Amiga right, if only Hyperion had done this or that........ if you dislike what happened, you can either make a positive difference or move on and let it go.

Edit: On a second thought, if it gets into the wrong hands, the classic port will likely vanish. Fingers crossed for Hyperion.

Hmmm... Well, A-eon could buy/license code that makes OS4, and rename it, thus removing the need for McEwen's agreement...

Not necessarily. AFAICT, this is what you need to continue OS4 development:

1. os3 source code license + rights to distribute and modify
2. the work done by os 3.5+/os4 devs in the last 1.5 decades
3. a name ("AmigaOS" is a trademark owned by AInc)

#2 should only be a financial issue. I can't imagine any devs unwilling to relicence their work in exchange for finally getting some payment. And any exclusive licences Hyperion may have had would be void.

For #1 you could approach Cloanto and see what rights they have

Regarding #3: Cloanto could also provide a name, they own the "Workbench" trademark.

It's mostly a financial issue, I guess. Not sure how much cash you'd need and if anybody would be insane enough to cough it up in 2015. Especially given that the very important "Amiga" trademark seems to be out of reach for now.

As far as I know Cloanto has no OS3 source codes. Even Amiga.Inc had not these - OS4 project was based on sources from Olaf Barthel.

Straight buy out of Hyperion (with all assets and liabilities) would be best way - I think this is compliant with Settlement Agreement (parties of contract are still the same), but I´m no lawyer.

You don't need the actual sources, a bunch of people can provide these (like Olaf, as you mentioned). You need a license to use, modify and sell them.

The only way to shut up these naysayers would be to release the new OS. FE was not enough?

True that things are a bit slow. Waiting for the next still. In this while using Win7- I know I'm marked dead now but what can be done. This is reality. Still a die-hard Amyfan;)

I dont think that : Trevor buy AmigaWorld and Amiga.org ... plus meny programs ... invest 1.600.000 usd for the amiga x 5000 and amigaos 4.x and make hyperion goes in bankrupcy ...
I think something is mooving in background and soon we will have a great news
