@pavlor

I just report what I find.
You'll have to debate what it all means with someone else. heh.

I think you'll find TripOS in that category.

@thread

I must admit, this is NOT a filing I expected.
*You can't make this stuff up* (tm)

One day after Hyperion Entertainment's objection to Heinz-Alexander Drews' application for "Amiga" in Europe (euipo), we now have a 2nd objection.

Here is who claims to be "Amiga" in Europe today...

"The French of the Game" or something? Who/what is that?

Hyperion and Française des Jeux (the 2 opposers to Heinz-Alexander Drews' application for "Amiga" in Europe (euipo)) are notified of:
Quote:
commencement of proceedings

It's the same terminology referred to concerning Cloanto's euipo filings. (see post #253 this thread for reference)
Sadly euipo documents are not clearly accessible, as are the U.S. uspto documents.

I would be oblivious about all this without attention.
Thanks.

In France the Francaise_des_Jeux lottery exploit a game called AmigO
https://static.ladepeche.fr/content/media/image/zoom/2010/10/05/201010050106.jpg

But I have never seen a lottery game called AmigA here
So the claim for this brand name seems irrelevant from Francaise_des_Jeux that never exploited it

huge corporations usually employ armies of attorneys to watch for resembling names, titles, trademarks, stuff like that to clear field around their own corporate identity and ensure recognizability. they try to scare people into submission or buy them out if this doesnt succeed. heard a number of such cases in my friends circle first hand.

Well, Cloanto should hire better lawyer, their statements are laughable at best (if one reads Settlement Agreement and then Cloanto´s interpretation).

For start, compare Cloanto´s points 18. and 19. (page 5) and Settlement Agreement Definitions/d. (page 1) and Grant/(b) and (c) (pages 3 and 4).

Again, I'm not a lawyer and I won't speculate on how this turns out, but...
When I look at actions taken, at the very least I have to suspect "concern" on someone's part:

From the lawsuit:
Quote:
26. Upon information and belief, Amiga On The Lake, LLC, the business through
which Defendant (Hyperion) sells the Infringing CD-ROMs in the United States

From the web:
May archive shows Amiga Forever
September archive shows AF gone and 3.1 workbench disks listed
Current and both AF and WB missing

While widely spaced archive.org dates don't allow a specific connection between the disagreements and succeeding actions, it seems like more than mere coincidence, no?

Quote:
According to the terms of the license Hyperion Entertainment can market and distribute AmigaOS 3.1 in any form, through any medium etc.

Hyperionmp Source

It's possible a cease & desist prompted the removals, but it's also possible that all of this is a coincidence. If my information above is in error, I'd appreciate a correction. This is a lot to keep track of.

I just hope when this is all sorted out Amiga branded hardware that runs Amiga OS 3.x can be developed and marketed and that the classic OS will be back in development and not just patched up. If it doesn't happen then it will be a shame for the Amiga name but with AROS 68K and Apollo/Vampire hardware there will still be a future and the Vampire brand is growing strong in its own right. As for AmigaOne and OS4, well for those that like the platform I wish them an it well but it's not for me so I don't have strong feelings about it.

Merry Christmas, let there be peace and harmony in Amiga land in 2018.

There's an interview with Ben in the latest AF. I haven't got it in front of me but IIRC he said something to the effect that Cloanto's lawyers sent them a C&D and also got their digital downloads via Avantgarde, taken down.

I'm aware of that. The interview refers to last year and Hyperion's site.

My comments above refer to this year and AmigaOnTheLake, as you can see by the links.
If you're indicating by your post a relation between the 2 things? I think the Cloanto complaint makes it clear.

I don't understand, where should the development of 3.x lead to?
AmigaOS 4.x is the further development of 3.1.. Are you saying 4.x should be ported to 68k?

I suppose it should be if the Vampire needs a real AmigaOS to run on it's 64-bit 68080. Which it is said can play videos against a more powerful PPC machine that struggles. Plus unlike a modern AmigaOne it has vecotr processing. It might be based on Intel MMX but it's better than a missing ALtiVec unit. If they gets the funds for an ASIC the AmigaOne will be in trouble.
