@Lou

There is a lot happening in "real time" imo.
I happened to catch this when the Cloanto filing for Amiga Forever was removed from the euipo registry, yet although Hyperion show Workbench registered to them, the Cloanto filing still remained.
What I'm obviously saying is that the situation is fluid and perhaps more is to come.
We'll see...

atm, this is still true. You can confirm this here:
Source search
Then enter "workbench" in place of Amiga Forever.

Why would Cloanto withdraw opposition to trademarks that they clearly have been using for years and cede them to Hyperion?

Something is afoot which we Amiga serfs no little of as of yet.

The Amiga Forever trademark is especially surprising.

Re: post 385 (the filing for Kickstart trademark by Hyperion, which I only discovered much later)

Source

As with the other 3, there exists an earlier Benelux filing for Kickstart trademark by Hyperion:

Benelux search seems to have changed, so:
https://www.boip.int/en/trademarks-register
then enter "Kickstart"
You should see a list currently 6 items:
click on "1014998" and that should take you there.

I only mention this because it was stated in prior posting that Benelux registrations were a case for euipo (Europe in general) registrations. Since the other 3 trademarks I mentioned on the last page follow that path, it is possible Kickstart will follow that same path.

@number6

its kinda funny Hyperion now have Amiga Forever trademark, so does that mean they could stop Cloanto from selling there software in Europe?

Plus then could'nt Cloanto to the old trick and rename it Workbench 5.0 or something.

It pretty messy and very silly, after all who ever got the rights I think we the community now really define what we think what is Amiga related or not, not its branding. and if this all got really messy I think I would support AROS more.

@amigang

I've no doubt said this many times before.

This is merely public information that I find and share. I draw no conclusions from it.
Of course some of this is "puzzling", but I do not believe you can draw a conclusion from it regarding any sort of final resolution regarding ownership.

Nothing in this thread should change one's view about their hobby, imo.
If you enjoy development, continue to develop.
If you enjoy being a user, continue to use and enjoy your platform of choice.
If a product becomes available that you feel worthy of purchase, consider that as well.

Forgot to mention (since the euipo renewal of Amiga was the bigger story) that another euipo trademark was renewed the very same day:

graphic representation of powered by Amiga

Not sure whether this also fall into the category of "likelihood of confusion" with Hyperion Entertainment's "powered by AmigaOS" t-shirts. heh.

They don't *have* to, in fact. It's a matter of choices and priorities.

I keep considering the trust of Amigans in these companies badly spent. And not only the trust, to be honest.

Cloanto has answered (after having filed for extension to respond) Itec LLC's objection to the Cloanto filing for "Amiga" (uspto)

Source

For what it's worth, this answer and the new lawsuit (above) occur on the same date.

You'll need this for reference:

the 3 filings for Amiga (euipo)

Obviously, the fact that Itec LLC renewed the Amiga (euipo) trademark is not a done deal.
There is just too much paperwork still flying around between everyone who has filed.
We should have been suspicious when neither the Drew nor Cloanto filings showed signs of being withdrawn/cancelled/whatever.

Here is just one example today:
Drew objection to Cloanto's filing for Amiga

I'd love to hear how this makes any sense if Itec really owns the trademark.
Let's keep in mind that Cloanto's response to Itec (above) pretty much says that they've shown no evidence they are entitled to even object to Cloanto.
Why would Drew or Cloanto think any different then of Itec's filing in Europe?
And why would the French (see earlier posts) also extend their cooling off period with Drew if there was no point?

I await anyone's logical explanation, but expect none.

Itec has never owned (or used) any Amiga trademarks.

Refer to post #415 this thread.

2nd opposition filed against Cloanto for their Amiga trademark filing (euipo)

Source for both

Latest-La Française des Jeux

Again, if Itec's reregistration of Amiga (euipo) was a done deal, why are people bothering to oppose Cloanto filing for the same trademark?
