As far as I remembered ACube developed their products for an industrial customer, I might be wrong but it would explain some of the oddities of their PPC boards. I don't think their PPC boards are used for the Amiga market, that trademark seems to be out of reach for them.

After the lawsuit became known in March, 2007, it was announced as available for industrial customers. Surely you can understand the change in language regarding intent based on the events.
