Pascal wanted to offer these roms in his AppStore for 100 coins (=1 EUR) and licensed them officially from DCE. Unfortunately it seems that DCE had not the rights to license them and the owner gives no permission but seems to tolerate that they are available free of charge in the web. But use for commercial purposes is not possible. So the Roms are not legally available but illegal tolerated.

He wanted to distribute PC hardware running OS4, which would have required these ROMs. The offer in the app store was just a byproduct (his words, not mine).

Let's avoid creating an "one frigging Euro! these people are nuts!" urban myth.

@Cgutjahr

Indeed. As unfortunate as this might be from average users point of view There has to be remembered the other side too.

If Ralph had never made Cyberstorm ROMs in the first place, no one would be complaining. Now that he have made them at one point in his life, does that mean that he should now make them available to the public one way or other? Of course not.

Especially when you consider that one scenario in this is that having these ROMs legally and for cheap available, could mean less sales for MorphOS (which he is deeply involved with), as it might well be that some people get MorphOS instead of AOS4 because they are able to get reasonable MorphOS machine for cheaper price.

I was about to buy MorphOS once when there was cheap offer on suitable machines handled by one Finnish guy, but I was too slow and they were gone before i got one. And that was solely based upon the point that it was cheap enough and I didnt have AOS4. Had the price been higher (as it have been after that in sense that no nice cheap machine have come in front of me anymore without me having to look for one) or had i had AOS4, i dont think i would have even tried to buy one of them then.

So should Ralph shoot himself in his own leg just because it would be nice for average user? Of course not.

we can argue wether that view is right or wether more AOS4 PC sales would also increase MorphOS sales (as i actually believe it would), but if Ralph believes the opposite, then there is nothing wrong with him keeping legal ROMs out of average users reach.

But in case he reads this message, i would throw him suggestion. How about giving those ROMs to those who buy full copy of MorphOS?

I could see a chance of myself buying copy of MorphOS just to get legal PPC ROM files on a day i happen to have suitable extra money for such a thing. And I could also see that leading into me actually taking the effort of finding some cheap suitable MorphOS machine to be able to actually use it even, since MorphOS have always interested me a bit, but just not enough that I would have actually got it for myself. But including ROM file in addition to MorphOS, giving me possiblity to try out AOS4 with my PC, that could be lure enough to get me to finally try out MorphOS.

I wouldnt pay 100 Euros from a PPC ROM file, but I could see me paying 100 Euros from PPC ROM file and MorphOS bundle, despite the chance that it could happen that i would never actually use MorphOS.

And just in case pointing out so i dont misinform people about MorpOSes price that it is not really 100 Euros, its price depends to which machine you buy it to, and starts from 49 euros at cheapest ending 111,11 Eur to most expensive.

@OlafS25:

It is the typical "Ohhh the others could benefit from it so I forbid it" attitude.

As I already said on AN: To understand why this is so personal, you need to have witnessed all the nasty mud fights from 12-15 years ago.

Work together? Never... the others could benefit too from it.

I'm not exactly known as a big Ralph Schmidt fanboy - but aren't you overreacting here? Pascal wanted to use these ROMs commercially - and from what I hear, he's not the only one.

You're asking Ralph to give something away for free that apparently still has some commercial value for several parties. It would be nice, if he'd do that - but it's certainly not a crime if he doesn't.

Go ask Ralph for a commercial license. If he refuses that, you can come back and complain about his attitude.

He will not release them to the public or LICENSE at all.

(my emphasis, and "he" as Ralph Schmidt).

Personally I however see Schmidts move, although unfortunate for myself (and many others), reasonable move for him. Supposing of course that the point in refusing is in being afraid Competition (AOS4) getting advantage and MorphOS losing sales.

What a mess....

It is sad to see people making a fight upon a dead horse's corpse for no reason. The very same time when other people try hard to make something nice happen.

Another lost chance...

There is no "them" in this. You are discussing the choices of an individual regarding something he built on his own.

You are the one throwing verbal stones here. The person you criticized merely pointed out a misconception regarding the ownership situation of his own property and then went back to a state of peaceful meditation.

Is there any evidence about this agreement with DCE?

Evidence?

Why should anyone doubt about that? It is worthless anyway
