posted by MikeB on 6-Sep-2003 6:33:22 (4917 reads)
NewsALERT reports:

"Be Inc. (Nasdaq: BEOS; OTC: BEOSZ.PK) and Microsoft Corp. (Nasdaq: MSFT) today announced that the parties have reached a mutually acceptable mediated settlement of an antitrust lawsuit filed by Be Inc. in February 2002, which is currently pending in the United States District Court for the District of Maryland in Baltimore. Be will receive a payment from Microsoft, after attorney's fees, in the amount of $23,250,000 (U.S.) to end further litigation, and Microsoft admits no wrongdoing."

It's always the case.

I remember a couple of years ago, one of the US courts ordered Microsoft to split into two companies, "Micro" and "Soft", something like that anyway, but it obviously has not happened. Yet the media has said nothing of it. Looks like the "Military-Industrial-Microsoft Complex" is in full swing again.

If they truly consider themselves to be innocent, they should not pay, but see it through in court.

If Microsoft make Sky Net humanity will still have a chance. Can you imagine all those terminators shutting down after the latest virii make the rounds?

Actually, that was part of the Anti trust case, and the result of that was not to split the company up, but instead to make them make the APIs available to people, to remove the interconnectivity of IE to the OS (which still hasn't been 100% achieved anyway), and to make it easier for compnents to be replaced by 3rd party ones like browsers, mail programs etc.

....and this is of relevance to AmigaWorld.net because?

Whilst Im quite happy to read broader horizons than the Amiga market, the relevance to Amigas and Amiga company should be editorialised around the story submissions IMHO.

Sure, Amiga Inc has some kind of deal with MicroSoft but does this mean that we have to read every bit of news about MicroSoft?

My 'take' on this topic/story is that THIS BEHAVIOUR is reminiscent of US Automobile makers . . . . . .

How, rather than spend $22.50 more to fit a better fuel tank mounting in each unit that comes off the assembly line; they prefer to just pay settlements of $7,000,000 to each widow who dies when her husband is burnt to death in their exploding automobile!

Rather than modify its behaviour, MS® prefers to just settle with each IT business litigation. That says, straight off, that they have way TOO MUCH money!

Even if they believed themselves right, there comes a point where the truth becomes more expensive, in the medium term, than just saying "aye ok - we did it".

Naturally, I'm not condoning any of Microsoft's questionable actions from the past but I think that's why they payed up. They're a business after all.

On a different tack, I'm interested in what Be plans to do with all this new found wedge.

This money will only go to paying back Be, Inc. investors. In fact, the only "Be, Inc." that still exists has been maintained solely for the purpose of pursuing litigation against Microsoft and funneling any money received back to investors. All of the Be, Inc. IP is now in the hands of Palm. Some of the remaining Be engineers are at Palm as well, and others scattered to the winds, some ending up at Apple.

As for DaveP's question, I imagine this might be interesting to Amiga users in the sense that Microsoft and Amiga are -- very broadly speaking -- both in the desktop OS market, and Microsoft's reaction to Be could be of some significance to other alt OS vendors. Of course, BeOS was much more a concern to Microsoft in 1996 than AmigaOS is in 2003.
