@ChrisH

From the release:

Quote:
the exclusive trademark “AmigaOS” (Amiga operating system) and using other associated trademarks (such as the “BoingBall” logo)

I'm guessing the trademarks "Amiga" and "Amiga Anywhere" still rest with Amiga, Inc. But certainly they are not as valuable with the loss of "AmigaOS" and its related logos.

I suspect they've not really "existed" since they lost their offices. I bet its just a name now, Bill McEwen probably has had another job or is unemployed for a while, I can't imagine he's working on Amiga Inc stuff in an office from day to day can you? Especially after Pentti Kouri passed away, they can have no other investors of funding surely?

Plus their website has not had any changes in around a year.

@fairlanefastback

So Amiga Inc cannot call any future OS Amiga OS?

Hyperion can make an OS 5.

Glad to see Hyperion came out on top. I always felt they had the much stronger case. Even if Tigger were around though I'm sure he'd quickly point out that this is a settlement and not a court decision. Somehow I doubt he would change his stance that Amiga would have won in court in the end. I don't miss those threads battling with him over the court docs.

I have a feeling we will never know officially what Amiga Inc - Itec got out of this deal. Most likely it's money, but how much?

For all we know Amiga has no money to pay their lawyers and just threw in the towel for a token amount. Maybe something to keep payroll going for Jamie for his contract terms or something. We'd all just be guessing anyway.

@damocles

Or maybe Amiga Inc have done a total vanishing act and stopped defending it, therefore an automatic win for Hyperion? But yeah we're just speculating.

No, a settlement is signed and agreed to by both parties.

Which brings us to:"Jamie release that DevKit!!" (or at least give out the source code)

s this because Amiga Inc are going to call their OS by another name?

I don't know what exactly will Amiga Inc do next. This silent retirement from the legal battle, after so long silence from McBill and Co, some months after that their richest investor died... sounds much like a selling of IPs to Hyperion. Probably Amiga Inc will fade away, probably they will try to transfrom their AmigaAnywhere project into reality, in any case, they might have considered that their lawiers costed much more than developers.

...or maybe next action will be Hyperion to buy Amiga Inc and change its name to... Amiga Inc.

What I meant by them having nothing more of value their investors might hope to sell was: AI may have hoped to gain OS4, and sell it to the highest bidder. Without that hope, AI doesn't seem to have any real prospect of making money, so closing them down ASAP is the best course of action (from an accountant's point of view).

Hyperion can make "AmigaOS", any version number it sounds like.

Amiga, Inc. it sounds like can still make "Amiga Anywhere" or any other Amiga name so long as its not "AmigaOS".

@fairlanefastback

This was quite surprise.

Quote:

Hyperion is granted an exclusive, perpetual, worldwide right to AmigaOS 3.1 in order to use, develop, modify, commercialize, distribute and market AmigaOS 4.x

It seems that AmigaOS 3.1 (and below) is still owned by Amiga Inc. (or whatever company, KMOS, Amino, you name it), but not Hyperion Entertainment?

Oh, and this one:
Quote:

under the exclusive trademark "AmigaOS" (Amiga operating system) and using other associated trademarks (such as the "BoingBall" logo).

If AmigaOS 3 is still owned by other party than Hyperion Entertainment what about the name?

No, Hyperion clearly stated it's a settlement so AI got something out of it. Had it been a court ruling, we would have seen motions filed on Justia.
