thare was already something wrong with the ownershoip of AOS3.x sourcecode. When C= (the original Commodore) went bankrupt, Escom bought a lot of right, rights for patents, names etc ... they forget to write down who owned the code. They have added the ownership of the OS source later.

If some legally buys a box that has the AOS3.x source code (old streamer tapes) and if he could profe he owns the rights to use it, he could claim the ownership of AOS3.x and AOS4.x (at least the part that based on AOS3.x) ... that would be fun.

Was it not true that Commedore got a poor response from AROS? That is, they can not use Aros as thought against their will. It has nothing to do with Amiga Inc. !?

Even more fun would it be if someone buys ALL rights from Amiga Inc.
How can it affect the forced agreement under the new ownership?

Let's say that Commodore buys all rights to Amiga Inc. but not the company itself. Then take the Commodore right to all registered trademarks of AmigaOS, etc. but no agreement between Amiga Inc and Hypeion.
It can be a fun nut to crack .... and fun with the Commodore as the owner of several of the Hyperion brand.

What might happen?

If indeed rights to AOS 3.x has not been secured properly the "funny" thing would be another split in Amiga community and someone starting new development based on 3.x IP. I wonder how H&P really adds to this equation. Another fascinating thing is how Amiga INC was able to survive all those years and yet manage to sing such strange contracts. Even more amazing is that there is always the other party who agrees to sign such contract.

Yes, writing contracts between different parties in the sphere is the really weird in that batter!
However, I understand the contract between Hyperion and Amiga Inc about new OS4.x. Amiga Inc wanted to save OS4.x away from demands to be passed to third parties if the company went under.
A good and bad wording. Good because then it would OS4.x rescued, bad because the party said the agreement with the wording used to try to grab it for yourself. It was not the intent of the wording.

What do you learn from this? Well, never trust a collaboration partner, when you turn your back away is your stuff away ....

Well, it's really a world war in the sandbox!
