| If Hyperion dissolves and OS4 development stops, what do the NDAs say about what the developers can and can not do with their knowledge about OS4's inner workings? If an OS4 developer decides she wants to contribute to AROS - can she? Last edited by kolla on 18-Mar-2015 at 06:37 AM.

No-Discolsure Agreements prevent people from publishing sensible data which are considered vital for the company's activity. Once the company's activity has gone, people are virtually free from any signed NDAs with that company.
Please notice, however, that while information can be free, code lines are still protected by copyright laws, which means that if copyrighted code is sold as asset to another company, and you obviously do not retain rights on that code, you can't spread it to anyone else.
If an AmigaOS developer decides to contribute to AROS, he/she should not commit already written code, but can always help implementing the same solution with a closed rooms approach. Coder A, coming from a former experience, can describe his solution to a 3rd party, which can share his(her new knlwledge with Coder B, who actually re-implements the solution. That's quite similar to what the whole AROS team did, after all: re-writing the code starting with the API description. You know what the result should be and why, then you write your own code to get the same results for the same reasons. |

I'm not sure about that, it would depend on the terms of the NDA would it not? After all information is IP and that IP might be sold on, so if the IP is to be of value the NDA would have to remain in place. Talking generally here not about Hyperion. It's certainly true that the ultimate NDA, The official secrets Acts, remain binding after leaving employment!

| So the answer is "no", if you have signed the NDA to have access to AmigaOS sources, you are not allowed to contribute code yourself to for example AROS, you would have to go through the much cumbersome way of having someone else implementing your ideas.

i had the powerbook 165c myself, actually. terrible display, but for me, it was magic. then i got a 540c, then a 5300c, then a 3400c, a G3 (pismo).... anyway -- you get the idea.

I don't think NDAs do matter in this regard - it's a simply copyright problem, IMHO. The knowledge you gained while working on OS4 sources can not be used for any other projects - unless the copyright owner gives you a license to do so.
It would be kind of hard to argue that you're now going to work on AROS, but you'll really never use anything you learned while working on the commercial OS that AROS is a clone of. I'm not saying it's impossible, but try explaining that to a lawyer.
