Hyperion Entertainment CVBA is pleased to announce that on September 30, 2009, it has reached a comprehensive settlement agreement with Amiga, Inc., Itec LLC and Amino Development Corporation, Inc., to bring all ongoing litigation and worldwide pending procedures between the parties to an end.

Wow this is great news... it feels like this has been going on for ever and now it's finally over. I too wonder if there's any significance in Hyperion's change in business entity type. Looking forward to future developments especially the 'most ambitious project'.

Yeah, I noticed that too. According to Answers.com it's a limited liability cooperative. Who is involved, I don't know.

According to this description:

VOF = Partnership (with unlimited liability)
CVBA = Cooperative with limited liability

So I guess they have just changed the business model. Perhaps they were concerned at their personal financial exposure over the whole legal mess, and just decided to change the company structure to limit their personal liability.

Often settlement terms call for limited information to be publicly released. It would not be surprising if we never heard anything more about it from either party.

The CVBA is a company which needs to be incorporated by at least three shareholders. Previously Evert Carton and Timothy de Groote were partners in Hyperion Entertainment so there must be at least one new partner.

It could mean they have got an investor, or perhaps part of settlement is that Amiga Inc (or whatever following company) got a share of Hyperion Entertainment or maybe just that ownership is extended to OS4 developers. The last one sounds unlikely for many reasons.

The change of legal form happened in April already when they also changed the company name.
