Problem is, what user is going to plunk down lots of hard earned $$ for a fairly high priced motherboard with an OS that is shrouded in such uncertainty. So what if Hyperion can find a way to legally sell OS4 in this fashion. Would you invest your money into it? What if you did, and next month a major contributor to the OS decides he wants his code back an no longer wants to sell it as part of OS4. Do you see how potentially volitile this would make the OS?



Something similar i said various comments ago but seems nobody cares

Well, quite correct, and you don't even have to add talk about OS5 to this. Quite a mess

Surely the contracts don't allow someone to arbitrarily void their components' licenses. There should be terms in there that specify any circumstances where that would be allowed, and disallows it for any other reasons.

But that was one thing I was concerned with back in the lawsuit days when bbrv was planning to void the contract between Amiga Inc and Hyperion, as I assume any contracts Hyperion had with 3rd parties depended on that one being in place. Void that one, and everythign falls apart al the way down, and you have to start over with every single contributor from scratch to put it all together again. I imagine that if that had happened, some people may have declined and pieces would have been lost. But I don't htink that can happen by some 3rd party's whim to not do that anymore just for the because of it if all contracts are still in place.
