Actually, given the current legal context, that would be the best move they could make, allowing the first ACK model to hit the market at the same time as the SAM. (Assuming Adam is ready within the timeframe mentionned in his press release)

That way no matter what turn the actual trial may take, it would show that Hyperion isn't trying to "compete" against AInc. nor to steal the "first to market" right that Amiga claims for itself, out of thin air I might add, since the actual contract implicitely grants that right to Hyperion/Eyetech (but that claim was a pre-requisite to substantiate their request for an injunction).

The judge may also have noticed that Hyperion is really doing AInc's job of polishing and promoting the trademark and product, and much better than AInc themselves ever could, so by denying the motion and allowing Hyperion to continue on, (being aware of the press release regarding the ACube partnership) he's also indicating that releasing a Classic and SAM version does not harm AInc's interests.

I just hope that Hyperion will keep forging ahead, that ACube will start distributing the SAM bundle and Classic version, while putting the originally agreed per-unit royalty in a trust account for AInc. just to avoid any further disagreement, should the trial take place, be dismissed, or (preferably) AInc. decide to settle amicably.
