I would bet you on the "massive value" of the "Amiga" brand. Someone should do some market research both in the USA/Canada and Europe and ask people what they know. People think Amiga died with Commodore and for a lot of people it still did.
To all intents and purposes it did. That's why, if and when OS4 is released, if they send out a press release saying "Amiga OS4 is now available" people will be curious. Look at what the new owners of Commodore have done with the Commodore brand. They got loads of press coverage particularly for their new PCs that they never would have got if they were just some random company. A brand is very valuable - even one that hasn't been in the public view for a while.
A lot of people here seem to have a negative perception of the Amiga brand, but I don't think that's the case outside of the community, precisely because everything that's happened since Commodore's collapse has been "under the radar".
Sure there will be people who sneer at the idea of running a new version of "that old Amiga OS" in this day and age, but you probably wouldn't be able to sell those people any OS which had functionality short of Windows (and maybe not even then). The first target has to be people who actually owned an Amiga, because they are best able to appreciate OS4 in it's current state. Then you can develop the OS further to appeal to a wider audience.

Well, I hope Hyperion moves quickly with ACube and gets it to market, if ACube is willing to take the legal risks. If Hyperion doesn't Move Forward with hardware, and this goes to court and AI wins, their will be NO new Hardware for Hyperion.
Both sides at this point stand to loose so much if they loose in court, they need to work out a deal.
