maybe because the name Amiga is associated with a bunch of morons who don't actually manufacture any computers nor produce any operating systems.
Only to people within the community. It seems to me that regardless of what you think about the power of the brand, a lot of people here are disillusioned with the Amiga name, precisely because it is owned by Amiga Inc, and they aren't too popular. Outside the community that hardly matters because the last time most people will have heard of Amiga was back when Commodore still owned it. The prime target market of ex-Amiga users might have stuck around long enough for Escom, but only the most dedicated of Amiga fans kept track of it after that, I think.
I think it's a moot argument anyway. If Hyperion can call OS4 "Amiga OS" at the end of this trial they will do. If Amiga Inc get their hands on the OS they will definitely call it "Amiga OS". The only situation where it won't end up being called "Amiga OS" is if Hyperion get the OS, but not the name as a result of the court case. In that event they will have to call it something else, so it's not like someone is going to have to choose whether or not it should be Amiga branded.
If it ever does get released as Amiga OS though, I hope I will be proven right, because OS4 could really do with the marketing boost that I believe the name can provide.
