If the court rules in favour of Hyperion, on the insolvency clause, then they at the very least can market OS4 under the Amiga OS name.

Is this because of the way Hyperion has conducted itself or did you never have an interest in buying Hyperion products anyway.

I wonder what happens if the court rules against Amiga with regards to Hyperion's counter claim that nothing was legally transferred from Amiga Inc Washington to it's purported successors.
That covers the Amiga brand, trademarks and IP, AmigaDE/Anywhere, the domain name, and anything thing else that Amino got from gateway. Since Amiga Inc Washington was dissolved what happens to it's assets?
