According to the contract, you don't have to be an AmigaOne partner to have OS4 ported to your board. Hyperion is an AmigaOne partner, so they have the license to develop and distribute OS4 to "PPC hardware developed and marketed for the Amiga platform".
Now IANAL, but "marketed for the Amiga platform" is a pretty broad term,
I agree, but you still have to try and wiggle ACube in as an AmigaOne partner to make it fit the mold don't you? This goes back to my earlier comment about the possible resurrection of Eyetech. If Eyetech has any thing to do with it, then it's definitly by an AmigaOne Partner.
