From the court docs and some armchair lawyers here, it looks like AInc may or may NOT have transferred all the trademarks, rights & IP while coconut shelling their debt to the now AInc Delaware!
If AInc botched it, and it is discovered that they DID, can Hyperion, MorphOS or, basically anybody, register and take/own any of these rights and/or marks?
Prior to the court case AInc was awfully busy updating their trademarks and copyrights. I wonder if this was accomplished under the presumption that they owned them. |
I would think it more likely that those with open judgements against Amiga Washington would have to agree to an auction/sale of the IP and a spilitting of what can be gotten for it to be applied against their judgement amounts owed.
Amiga Delaware was possibly updating trademarks in preparation of the lawsuit against Hyperion to beef up their intended exhibit list.
