AI filed the suit after Hyperion poached Acube from them.
tig i really believe this is the biggest misunderstanding between ainc and hyperion. i really don't believe that hyperion poached anyone or anything.
acube went to ainc for a license for aos4.
acube dropped the bomb that they had a third party rig aos up for macmini.
ainc stopped negotiating(i assume since there is no documentation stating the opposite.)
i think somewhere along in here ainc decided to pull the plug on the aos4 license. this i think was based (at least in part) on the bomb dropped by acube.
hyperion was preparing release of the classic aos4
hyperion needed a distributor so they asked acube to do it (eyetech was the distributer before)
acube and hyperion reached an agreement to distribute aos4 for classic systems and any other system with a license.(it was not stated this way but i believe that was the meaning)
ainc assumed this was an end run to get around the license for acube hardware.
ainc sues hyperion over aos4 after announcing their own partnership with ack in retaliation.
while there was issues prior to this i believe this is what "broke the camels back" as the saying goes. so really i think this case was based on misunderstandings but has now taken a life of their own.
