The license granted is for target hardware only. Hyperion obviously wanted to expand the target hardware range, and AINC. obviously did not want to. Each business looking out for their own interests. Now when AINC finds out about Hyperion and ACube, we end up where we are. Therefore I don't think it was a misunderstanding at all but understanding by each party, of Hyperion being sick of stuck with no target hardware and trying to remedy the situation. Now the judge will say if they had that right.
