Maybe I am too old and feeble of mind to understand. I thought Hyperion only had license for target hardware. Eyetech mb's and classic. This quote "Hyperion has repeatedly stated that our goal is to place OS 4 in the embedded market, namely for STB's, kiosk systems, point-of-sales and so on." is not for execSG but for OS4. While I can't blame Hyperion for wanting a license for other hardware (since there was/is only the classic left), they could not get one granted by AInc.
I see Hyperion wanting to do an end run around the refusal of Ainc. to grant additional license. AInc decided to put a stop to it. Now as to who is right it is up to the judge. Hyperion knew what was included in the license and what wasn't when signing. Of course they were probably expecting to always have a target hardware to develop for, but that is not promised in the contract.
Now if " hyperion was selling for use in set-top boxes,kiosks, etc " is granted in the license and these are target hardware I am completely wrong (usualy am), but please point out where I missed the news of the expansion of target hardware. Thanks
