Maybe I am too old and feeble of mind to understand. I thought Hyperion only had license for target hardware. Eyetech mb's and classic. This quote "Hyperion has repeatedly stated that our goal is to place OS 4 in the embedded market, namely for STB's, kiosk systems, point-of-sales and so on." is not for execSG but for OS4. While I can't blame Hyperion for wanting a license for other hardware (since there was/is only the classic left), they could not get one granted by AInc.

I see Hyperion wanting to do an end run around the refusal of Ainc. to grant additional license. AInc decided to put a stop to it. Now as to who is right it is up to the judge. Hyperion knew what was included in the license and what wasn't when signing. Of course they were probably expecting to always have a target hardware to develop for, but that is not promised in the contract.

Now if " hyperion was selling for use in set-top boxes,kiosks, etc " is granted in the license and these are target hardware I am completely wrong (usualy am), but please point out where I missed the news of the expansion of target hardware.

The MacMini port didn't sound like a port at all but a patch to get it to run on a MacMini. It got the installer to run and perhaps patched some hardware drivers for the HAL.

It's like replacing your car's stereo and wheels with some low profile 20's and an in-dash DVD system. It doesn't change the core of the car.

I don't see the MacMini "patch" as illegal from an end user application. Acube was just trying to get a license to be able to sell it.

Someone could just as easily post docs on a public forum on how to do it and users could re-build their OS4 install CD with the appropriate free-ware/open source files.

The thing with the "target hardware" is that it was not just *any* PPC hardware, but there was the requirement that it is "developed and marketed for the Amiga platform and userbase".

By that definition, something logical like porting OS4 to MacMini and selling it as a non-bundled shrinkwrapped OS wouldn't be possible. No, the only loophole would be to buy lots of used/refurbished MacMinis, maybe relabel them with some stupid girl's name, slap a boingball sticker on it and sell them for a much higher price.
