I don't think they would care provided that you make it clear what the motherboards are and who designed and made them. It's like the Terrasoft value-added Macs (Macs with Linux pre-installed).

Tell that to the people who wrote the OS4-contract. ;) I thought Adam was planning something similar, but (surprise!) it didn't pan out. I'm not sure if the reasons were really Apple, or if he even got to the point talking to them. I remember something along the lines that Apple's move to x86 made Amiga Inc or ACK step back from the idea. I will try to find the post or hope for #6 to fill out the blanks...
Buy lots of used PPC MacMinis, rip out the mainboards, put a MacMini-lookalike case around it, slap a boingball sticker on it, call it "Moana" and sell it only bundled with OS4.

legally i don't think that can be done anyways but as an example it is a reasonable comparison.
if you sell used equipment(in the us) it has to be relabeled as remanufactured or used. thereby limiting what you can charge iirc.
