The judge agrees that at this time not enough proof has been presented to the court to prove that OS 4.0 was completed in December 2004.
See previous post's quote.

But I think Amiga believed it was ready because they started coughing up money.

There's a pretty good analysis submitted to the court by Hans-Joerg Frieden, which goes through each feature step-by-step and shows that not only was it feature-complete in December 2004, but the feature set of that release even exceeded the requirements set out in the contract.
