Tigger, this is a court case, with lawyers involved, the plaintiff attacks on multiple points and mulitple planes, the defense does in turn. Hyperion asked for a much larger bond based on how much they have spent according to their claims on the product, over one million dollars. Thats Hyperions rationale and yes its likely tactical in nature as well because its not clear if Amiga has the money to spend to do that. After that Amiga said they felt $25,000 was a bond they could live with instead, with their rationale being that they claim $25,000 was a price tag to "buy-back" the OS, so why should it be more than that.
None of this has anything to do with you often presenting your opinions and conjecture as facts, often in direct conflict with the facts as they stand in regard to provided exhibits and declarations in the case. Your posts need to be read with caution IMHO.
As for the other $8850 yes you state Amiga's position. But since Hyperion is not about to drop defenses its raised, i.e., insolvency, other debts, required order of payment of debts, the $25,000 being a buy-in, not a buyback (in their view), even so that they should have a valid license anyway etc etc. They have not denied being paid the $8850, they dispute it having the significance Amiga Delaware wants to attach to the payment in a legal sense. Much of the defense's case rest on them saying that Amiga Delaware's payments hold no meaning because Amiga Washington hid their insolvency from them from their POV and that Amiga Delaware should not even have a right to bring this action. So they are not going to start acting like Amiga Delaware is a proper successor at this point in the game.
