they couldn't because as far as hyperion was concerned this didn't exist. acube commissioned this through 3rd party developers(os4 developers) acube should have gone to hyperion & ainc before proceeding just to let them know they were attempting a port. then return to them to get the license when complete. as it stands hyperion's eyes are black because acube implemented moana behind their back(or at least that is the impression i get reading the dialog between ainc and acube).
