Speculation:
Hyperion *did* sign a contract with Itec, which quite clearly says "pay $25k, get the OS", so there can be no doubt that in April 2003, Itec was entitled to buy the OS from Hyperion. It's a two page contract, not a lot of room for interpretation there. Now whether that right ended up at AI(D) eventually or not could be under debate. Hyperion have made a big spiel about the "not" part. So Itec calls their bluff, and says "look, guys, we have this contract. We signed it, you signed it. Here is your $25k. Please hand us the OS, or explain why not", with the implicit "You do, after all, say that we never transferred this right".
Clever move, I must say. I like it :)
