IANAL but; Surely, because of the contract stating, and Hyperion accepting, jurisdiction under Washington & Seatle courts, thats where any new lawsuit would have to be held, and not New York. Otherwise Hyperion could just as well claim that any new lawsuit has to be under the jurisdiction of the Belgium courts.

That's your premise. I believe it massively overstates recent events.

A judge (who was indeed somewhat confused on a rather central point) declared that things weren't crystal clear yet, and that also no damage was being actively done right now which could not be cured by paying money, and that thus no injunction was necessary. Or, in colloquial terms:
"It's clear as mud, and nothing is happening, anyway. Get on with it!"

Many (many :) years back I played in a soccer team; That team's centre forward had a habit of kicking the kickoff straight at the opposition's goal. So if we won the coin toss, the very first action of the game would be a long-distance shot at our opponents' goal. As far as I remember, each and every one of those shots, throughout the season, either missed or was saved. We never scored in that first action. And yet, we won plenty of games that year....

To *try* and do that, you mean, right? They filed a motion. I would be extremely surprised if their motion was approved.

Another interesting element in the letter from John is him saying Itec paid already. But we are paying again anyway. Yet he seems to be likely including monies Amiga Delaware probably paid rather than stuff Itec solely paid. I think they've gotten a little too used to treating all of Pentti's firms as one big cloud rather than with the level of separation they should have as stand-alone entities.

Even in the current Washington case you have money coming from Tachyon, you have (maybe) money coming from Bill personally.

So it seems they act separate only when it suits them (from the bit we can see anyway).
