Actually, I assumed that you DIDN'T lack solid fact. So... you don't know. That's dissapointing ...but what I'm looking for *IS* solid fact. You say everyone lacks it. That's nonsense. Obviously Ryan knows, Obviously Amiga knows (BOTH of them?), Amiga's business partners should know, that's really wierd to say the least.

Er I do use OS4 because of it's name. It's Amiga OS4 it runs on my MicroA1.
- It's Amiga OS. There isn't anything else called Amiga OS 4 is there? MorphOS is Amiga Like, but it's not AmigaOS4.

Surely logic dictates I am correct?

I really don't get you at all either.

Since you KNOW so much about Ryans business and Amiga Corp (whatever that is) then please tell us what it is that he is selling and what the company is registered as?

If you can't answer those questions then pray tell all of us here how he could be infringing on the Amiga trademark?

In case you haven't gotten it by now just by registering a name that is already registered isn't a trademark infringement!

Before an infringement can occur you have to know if he is selling in the same segement as Amiga products are and you would have to have a product at the very least!

There are several companies bearing the name Amiga if you look up in the US trademark Tess but I don't see any court cases being filed against a) a bathtubs, faucets, lavatories, showerheads, spas in the nature of heated pools, toilets, and whirlpool baths retailer or how about b) AMIGA INCOME TAX AMIGUITO or maybe c) TU AMIGA REAL ESTATE still you might try and make a case out of this one Amiga, Magnetically encoded prepaid or reloadable stored value cards, which is located in Vegas but I don't think that you can make a good case out of this one either.

As for the value of the Amiga name. None of you can possibly claim that whatever 3-4000 something people that still follow the amiga could influence the worth of the name which was generated a number of years ago when millions of people were using it? Events far worse than that which has transpired over the last 10-15 years would be needed.

I have no idea what Bill paid for the Amiga name but he certainly has to be admired for taking the chance and for allowing the continuation of the desktop OS.

Some here complain about them hoving in the royalties from sold items but honestly I don't see anyone driving around in a Rolls Royce from royalties alone.

Personally i wouldn't mind seeing someone more desktop OS oriented take over the rights and pouring gobs of money into Hyperions and Eyetechs coffers but 1) I don't see Amiga Inc. letting go of the name cheaply and 2) Who would make the investment?

I wouldn't count on a bankruptcy giving anyone here a better position in the future. In a bankruptcy anything can happen and there are scenarios a lot worse than what we are living today!

Listen to the people, ok? Lack of public law suits against Ryan does not mean that anything Ryan ever does is legit. It might just mean that there isn't anything to catch him for yet.

If Ryan took over Amiga Inc you can bet your sweet hat that almost everyone here would walk out on him. So even if he by some miracle managed to acquire Amiga Inc that wouldn't actually help him any.

We all know Amiga Inc hasn't always had sweet moments in communication with the community. Now multiply the worst of those moments by about a gazillion and you will know how I would react to him

Until Ryan starts developing and selling hardware, software and operating systems he is unlikely to be infringing Amiga Inc copyrights. As far as I can tell he does not currently sell anyones products let alone his own.

If he did however breach their copyrights, they are probably too weak to take action.

Oh and by the way stop winding Rogue up. You really pissing me off about this, and no doubt quite a few others. I'd rather you just drop it now, and don't reply to my post.

Any thing bad that happens to Amiga Inc reflect it self on AmigaOS and every thing else called Amiga.

Brand name are only useful when you can capture the markets interest, most folks think about Amiga they don't think of mobile devices, they normally think of the game console from the '80 or the desktop computer, or some hot Spanish girl friendly.

I think the name as grate value if used correctly.

I think Amiga Inc helped the community whit lots of things,

they sub license AmigaOS to Hagge Partner
for AmigaOS3.5 and AmigaOS3.9

they outlined first plans for AmigaOne add-on card for A1200/A4000

They sub license AmigaOS to hyperion for AmigaOS4.0.

I think the biggest error they did where to to NOT give it to Hyperion earlier on.

the work on AmigaXL and Amitalon (Amiga x686), where big joke as it where just modified version of UAE running on top of QNX or Linux kernel, bad idea that did not move the OS foreword, and I think it looked unprofessional, from then on you see decline of uploads on Aminet, and the general public loosing interest.

and the deal whit Gensi / bplan where big mistake as well, this is one of the things that almost bankrupted AmigaInc, then the focus on AmigaDE / AA, at the end.

Is this really any of our business, we will never know what goes on behind closed doors, people come and go in any business, some people, such as Gary have a public face and get noticed, but usually, business goes on as normal. And as far as everyone is saying, Amiga Inc never did anything anyway, so what's changed ?

We as users and developers can still do our thing no matter who is in charge this week. Nothing of what I have read will stop OS4 being released, or the Amy05 work from continuing. The Sun will still come up tomorrow, and go down again tomorrow night. Nothing has changed IMHO

Eh, he should have used another wording, but I'd guess that his point is, you use AmigaOS because it's AmigaOS, it was based on the code and builds on it (even if most of it was rewritten). Now, in the case that something happens and the same OS cannot be called AmigaOS anymore, for some stupid
reason, would you stop using it? Nope. That's the point.

I agree with Kjetil, MorphOS is not AmigaOS in the same way that Linux is not Unix
(but certainly not in the way BeOS is not MacOS, BeOS is not MacOS compatible).

That's not the way things work with trademark infringment.

A company - like say, APPLE has to Prove in a court of law that they have tried to stop various people from Using their names.
for example, if a person makes something that can be used with an iPod, is Giving it Away For Free, but calls his web site "iPod-MyStuff.com", Apple will send him a Cease and Desist legal letter to not use the term "iPod". (something like that happen in the last month so this isn't a made up story).

it matters not that he isn't making any money. if Apple doesn't Show that they are protecting their name(s), someday some guy can go to court and Prove they aren't being diligent about it and take the name and whatever $$ is associated with whatever that guy is selling.

I understand what T-bone is ASKING. the only people who really should be concerned are Amiga,Inc
we don't know if they have sent the moron a Cease and Desist legal letter, but they should.
the only issue is that we don't know what Amiga, inc thinks of this and if they are interested enough to do the legal thing.

From what i understood, they got permission for OS4.0, but not for future products with the exception of update packages.

you are missing the point.

Maybe it's an "american thing", i can't say. I'm no legal expert. But in america - and Amiga, Inc is in America - if a company does NOT Prove they are protecting their trademarks and copyrights, they can lose them. period.

it has nothing to do with whether Ryan is selling anything. it's all about his using the Name.

Once again, I want to point out that we don't know what, if anything Amiga, Inc knows about this. If they did anything, and so it goes.
