Hmmmmm. I must say that I am more bewildered than ever before.

I thought that this discussion started something like Quote:

Now it seems to me that you're saying that Amiga Inc. has nothing worth protecting. The name Amiga is worthless as it is and the thought of trademarks themselves are worthless doubly so and if there was any value left Amiga Inc. doesn't have the resources to enforce it anyway (given it is enforceable at all).

Now I think we've come to the same conclusion here (albight through very different views on the issue) and that is that it's not strange in the least that Amiga Inc. hasn't adressed this "trademark breech"!

The only other thing discussed here is your "idea" that Ryan has bought and paid for his "right" to use the "useless" trademark from Amiga Inc. while saying at the same time that he doesn't honor contracts. Seems to me more like proof that Ryan would just rather take the name than pay for it! You make him out to be more or less untouchable in a court of law.

Maybe the Amiga name has no value left, but look at Atari there's nothing left but the name and it surely never had the name that the Amiga had!

The rights to the Amiga name that Amiga inc. aquired have only to do with the OS anyway. All hardware patents from Commodore and (Amiga related such) were kept by Gateway. Since the Amiga OS is a software product I imagine the trademark would cover anything that made use of the Amiga OS to sell it's product. That is what BB was after. I guess that is the type of lisence Hyperion pays for each copy of OS4.

Still I don't know anything and I'm stupid to boot. Not to mention tired.

I hate to even get involved in this thread.

Amiga like Apple isn't really a trademarkable name.

they are generic words that can be used be any company to register in the U.S.
Example Apple transport Inc, Apple shipping Corp.

you could start a company called BPLAN INC. In any state it is not already registered in an the other company could do nothing about it.

Amiga Inc really has no legal ground to go after Ryan yet so much of this thread is about NOTHING.

The only reason it was brought up was for FUD value.

That being said how many mac sites exist that use Apple computers names and other things in the web address and Apple while not happy about it. Can do little about them.

Microsoft has in my opinion hyjacked the generic windows term. But to do so even for them. It took a tremendous amount of money, legal cost's and politcal pressure from certain states senators who all got HEFTY sums of "contributions" from Microsoft to accomplish.


This whole thread is really much ado about nothing.

As you seem to believe Woods (he's the only possible source for your "rich kid" quote), why not simply ask him on moobunny? You must have missed several statements from Woods already anyway (along the lines of "he's broke", "his credit rating is abysmal"), so simply using Moobunny's search function might bring up some interesting tidbits.

IIRC, Rich described the whole "Amiga Corp." affair as "the poor idiot spent his last 50 dollar on incorporating as Amiga Corp. He'd better spent that money on food as he's not going to keep that company name anyway".

I little generic information for some people.

Company names and trademarks are two differnt things, your trademark doesn't have to be the same as your company.

I could own a company called ABC Ltd and own a trademark called "Pen and Paper Developments".

Here is some interesting reading, go to this site: http://tess2.uspto.gov/bin/gate.exe?f=searchss&state=402b8l.1.1 and search for Amiga.

There are trademark applications (not all registered) for the use of the word Amiga from the original Commodore application (serial - 73571532) to sanitary female napkins (serial - 74331914) to Amiga Development LLC's application (serial - 75642361) to Bill Bucks abandoned applicaiton (serial - 78258059).

How do you describe a 19 year old who has $100,000.00 in cash to lend out? If that doesn't qualify as "rich" then you're out of touch with most of us, who generally only ever see a lump like that when we sell a house or roll over a retirement account.

Just the fact that he's owed $100.000.00 by Amiga Inc makes him rich by most people's standards, even if his pockets are empty. Collection is going to be a bit of a struggle though

There's a toggle control for "threaded view" that should keep you from seeing replies I make to posts mentioning Ryan, fell free to use it. I haven't posted about Ryan for at least a week, although I've replied to a few. "threaded view" will prevent you from seeing them.

That's true, but if someone who sold your products named their company "Pen and Paper Developements" and your customers asked if they were affiliated with you, I'm sure you'd answer them, and make it clear they were not affiliated with your trademark. If you didn't respond, your trademark would be in jeopardy, registered or not.

Although we don't know that that's the case here, Amiga Corp may or may not be affiliated with Amiga Inc, and we won't really know untill one of them says something. Right now they're both quiet.

I didn't say he never was "a rich kid". I just said he no longer is (if we are to believe Rich Woods' claims).

You are constantly reffering to information provided by Rich, but always ignore additional information (provided by Rich aswell) which doesn't fit your POV.

According to Rich, he was owed $100,000 by Amiga Inc. and at the same time owed a remarkable amount of money to Dave Haynie and some other guy 'employed' by Merlancia. He made a deal with Amiga Inc. where they do not pay him, but pay his former employees instead. In other words: He's no longer owed $100,000 by Amiga Inc. - i.e. he's no longer "a rich kid".

What POV? I have no agenda with regards to Ryan, Rich does I'm sure. Nobody gets that nasty unless there was once sex involved. (my guess is there was)

I can't prove that part, that's why I don't mention it, not because it "doesn't fit my POV" It doesn't sound reasonable anyway, why not just pay directly the people you owe rather than lend to a third party who promises to pay your debt in return, especially since it's unenforcible? (Not even forgetting that Amiga hasn't payed them, so Ryan is still owed this money anyway)

Anyways, the fact that Rich provided this same information is coincidence, just because I believe some of what he says (only because it can be proven BTW), that doesn't mean I have to automatically believe everything he says.

That's not to say that I'm aware of him being wrong about anything so far, but much of what he says that isn't backed up by court documents is rumor, even though many of them have turned out to be true I haven't elevated him to some "infallible" status where I'd trust everything he said. You're free to if you want though.

Who said I took Rich's word for it? Rich wasn't the only one who knew of it firsthand you know. Like I said, it's just coincidence that Rich said it too, he's not the only source of this information. Personally I know of it because Dave Haynie mentioned it, not because of Rich.

Anyway's it's not a "theory", I said it was a possibility, not even one I believe, just something I said was possible.

No. I can't believe something "just" because Rich says it's true. Rich said Ryan would go to prison too, but did he?

Who said he invested? We know of a loan, and we know of an asset purchase. The asset purchase is documented in press releases all over the place, including Amiga Inc's own site. The loan is mentioned by Dave Haynie, and Skal Loret was a witness to it as well.
