Sorry to keep it going, but I thought that Garry Hare and KMOS had bought or somehow "taken over" Amiga Inc?

Nope. He was appointed by the equity firm that own Amiga Inc. Most likely to salvage what he could from the mistake they made. The whole ITek/KMOS shady nonsense seems to have been done because of the legal issues from Genesi at the time. God knows. What a wasted mess. 5 years of owning the name and going backwards.

Thank God for Hyperion. And Eyetech - abortive now but without them we wouldn't have any hardware.

I think it's clear that Amiga Inc, if it exists, does not have the
ability to protect any trademarks it may or may not own.

It's not like it would be a complicated case. I bet I've had traffic tickets that took more time and money to resolve than the simple revolving door effort needed to spank someone blatantly taking your name.

That's why I don't think it's that simple. I suspect he didn't actually "take" the name, as I remember it, Amiga Inc, DID owe Ryan quite a bit of money, at least $100,000.00.

I'm dissapointed with all that's happened that more people arn't interested in grabbing the brooms and sweeping the piles from the dark corners into the sunlight in the middle of the room where everything becomes visible. Heck, these days I don't trust ANYTHING left in the shadows.

You couldn't know that for sure - more likely there was an idea there but it never materialised. We're VERY used to that in the Amiga world - a bit like our 'partnership' with Matrox which consisted of showing their logo on the Amiga.com page.

It is unfair to say Gary lied but you need to take future promises with a pinch of salt. Nothing is real until you see it yourself.

Garry Hare, what is his legacy?

He came into Amiga Inc, when they were doing nothing and being silent.
He did some shuffling and some networking trying to salvage it.
He got the T-shirts out.
He left.

He tried I guess, and in true Boy Scout fashion, he left the area better than it was when he arrived. He never really cared about most of the things that are important to most of us, but we all knew that when he came anyway.

Which rumor?

The rumour brought up by yourself, in you orginal post:

Quote:
(I have a feeling the most important asset, the name, has either been licensed, sold, or they are just not interested in defending the trademark anymore)

That rumor. Your post, #41.

So may I ask why you say "which rumor"?

Quote:
Ryan Czerwinski incorporating "Amiga" is legally documented fact.

So? There is a Hyperion book store, a Hyperion records label, and there is a Hyperion company that make business software. I think there are a total of 36 or so companies with the name Hyperion. I don't exactly see why a company "Amiga Corporation" should be an indication for your rumormongering.

Quote:
As to why this is so, what's your take on it?

See above. Not that I would have any opinion on the matter anyway.

There is a company called "bplans" by the way (www.bplans.com), as well as a company b-plan (www.b-plan.com).

A sign? I am sure you can come up with a nice rumour around this one as well, can you?

Maybe because unlike the 36 or so companies you mention, Ryan has actually had something to do with the Amiga? For example, in my area there is a bar named "Moon Cricket Cafe" and recently a citizen petitioned the city to force the bar to change it's name. The reason being, "moon cricket" is a racial slur in a far-away corner of the Notheastern U.S. The petition was refused because in this area the term "moon cricket" is not known as a racial slur and it's obvious that the person running the bar did not intend to offend. However, if this same bar had been named "Jiggaboo Jungle" you can bet it never would have been allowed to open. Do you now understand the reason why when something is clearly associated with a name it might be taken by some as more than a coincidence?

Technically if Amiga Corporation started acting in the same area as Amiga Inc the Amiga Inc may have a case. It kind of boils down to the question "Would it confuse the consumer to have these two companies both exist?"

To answer that question you really have to take into account things like logos, advertising, trade channels etc.

Actually if you don't know what your doing then you should really consult a professional, this can become quite expensive.

If you think you have an idea what you are doing and whip off a threatening letter, whats to stop the other party ignoring it? What do you do then? Probably consult a professional, costing money.

It is pretty far from a "revolving door effort".

There's also 'Amiga Developments LLC' which still owns Amiga IP.

I understand all to well. It's the usual crap that someone "leaks" into the world that is commonly bundled under the three-letter-acronym "FUD". Fear, Uncertainity, Doubt.

You can actually look up the owner of the Amiga trademark in a trademark directory. I invite you to do so and find out who owns the trademark.

Did Merlancia or any derivate thereof actually *ever* do *anything* except talk a lot? AFAIK, they didn't.
