Spot on, I couldn't have said better myself. The only thing I think you got wrong is this:

You have to ask yourself why Amiga Inc doesn't want Hyperion to sell OS4: My favoured hypothesis (which isn't new) is that Amiga Inc wants OS4 solely for it's IP value. This (and their frequent lack of funds for lawyers) explains pretty much all of their actions & inactions since the dot com bubble burst (and thus presumably their VC's wanted some of their money back). edit: So I expect Amiga Inc to keep posting blatant lies about OS4 being the number one multimedia OS (etc), until they can con someone into buying it for far more than it's worth.

Very strange that they, announce new hardware the same day as they announce they wil sue the programmers of OS4 ? How stupid is that ? And they will include OS4 with this new machine, without developers ?

They don't need OS4 to be developed further, after all they have their OS5. What they're forgetting is that most talented devs who care about the future of AmigaOS are involved in the development and/or betatesting of OS4 in one way or another, so they have very close bonds with Hyperion. So actually Amiga Inc. would lose more by winning this court case, than if they lose the court case. If they lose, they will have to share the profit of OS4 sales with hyperion, instead of taking it all. If they win, they will lose the majority of developers who are still active on the Amiga (and probably most users will go with them), so they'll have full rights to a completely dead platform. It seems I have overestimated the intelligence of Amiga Inc.

Even if I am (hopefully) wrong about Amiga Inc, and ACK do actually deliver on their promised h/w, I really can't see how they can get OS4 for it until the legal battle is over - which has got to be 6+ months away IMHO. I really think that this delay & uncertainty (even in the best case) will have killed OS4's chances by then. Thank you Amiga Inc & Bill McEwan for killing OS4.

... aaand perhaps a little bittle thanks to Hyperion for not giving a #### about the contract they signed (if Amigas accusations are to be believed)? I like Hyperion as much as anyone for doing the OS, but they are not above the law and can't just change the "rules of the game" on their own whim.

I do hope for a miraculous turn of events where the parties end up shaking hands and doing what is best for the community, though. Hoping, not believing.

Second thank Amiga Inc for not interventing one time in 4 years and doing nothing.

I think it might be an idea to consider revoking the use of members OS4 screenshots from the Ainc homepage. Is it worth having a poll on the issue?

Exactly. Neither Hyperion nor ACube are idiots. They would not have viable companies otherwise. I have been exposed to these types of cases before and I can assure you that both sides will have *extremely* different recollections of the events that occurred over the last 5 or 6 years.

I'm waiting to see what Hyperion's side of the story is before saying anything beyond that. Having read Amiga Inc.'s version of the events, I'd be willing to bet there were issues with the contract many years ago, and Hyperion probably has some grounds to claim the original contract was voided or changed a long time ago. I won't speculate on the reasons at this point but I can imagine what they might be. They would not blatantly countermand a written contract like that. And why would a second company (ACube) that was in negotiations with AInc. suddenly flip and go over to Hyperion's camp unless they knew something? Think about it.

Meanwhile, I've been lurking in this forum and waiting for *many* years to get my hands on AOS and some real hardware. What a shame.

Yes, it seems that only when it became apparant that Amiga Inc would not die and leave Hyperion the heir to AmigaDOS - they scuppered the Acube license with Amiga Inc and took it for themselves.
