now, since an amiga version is distributed with amikit, it does look like there is some exclusive agreement. is that so? or does the situation look different? i just dont comprehend the situation very well.

No, I was not taking about developing AmigaOS4.

We are taking a MUI a cross platform GUI toolkit that came first for AmigaOS3 then MorphOS and AmigaOS4.

Developer chose to develop programs using MUI because it is cross platform compatible.
The two teams are working on the same thing, so way not setup a common source code repository, fix the compatibility's and sort out the copyrights.

Well people are allowed to use the SDK to make software; I see no problem with that, the problems comes when copyrights are changed, or distributed without consent.

Given the shit Ben Hermans gave AROS and MorphOS over copyright of the Amiga Technology 3.1 handout, this is utterly appalling.

Modifying the copyright statement when you are not the author is theft, plain and simple.

What you call that clear and simple mistake which clearly wasn't done intentionally is neither a simple mistake, nor a involountary issue due to a machine-script misfunction. You can't, in any given circustances, change author's name in ANY kind of human work without his/her written permission, pretending "Albert Einstein" made that instead. It's not respectful either for A. Einstein, and for the real author too! Would you be happy if someone stole your writings and attribute them to themselves, just because he/she wasn't willing enough to look for your email address, and ask you?

What you call "simple mistake" is a disrespectful violation of copyright laws. Probably no one will be sued for this, and the mistake will be fixed in short time, but given the particular "cold war" running for years between Amiga camps, and the few money moving through them (I agree with you here: it's a madness, but there's little we can do about that), volountarily replacing an author's name for, well, absolutely no reason, is an absolutely unfair and avoidable action. I wonder what kind of advantage it took, and I've been really happy to read the apologies.

Maybe it just took 12 years to get notepad in a state it could edit the headers?

It seems problem is even worser than I thought. I just compared V36 dos.h and dos.h in MorphOS 3.9 SDK: little bit added, comments removed (some empty lines are obviously relic of copy/paste and removal of original comment - eg. line between error 232 and 233). Not only Hyperion, but also Commodore stealed code from MorphOS!
