Hyperionmp (Ben Hermans) addressed in his post (137 in this thread) working commitments of Friedens. His statement in post 60 is not in contradiction with current legal proceedings in Belgium (you linked to).

Can I ask, are you that third party?

This is an Amiga Forum and I think it is important to inform people in this forum about the facts in this case, because Hyperion is responible for the Amiga OS.

I ask who and what I want to - you don't tell me what I am allowed to ask and what not. No one has to answer me though.

That has nothing to do with putting my nose into the process.

Yes you are right. You can recover from bankruptcy and keep your company intact. And if you can do that, although more than likely the mediator that they assigned will end up firing Mr. Hermans in the process. Be more open. To keep things like "grave dancing" down to the minimum publish earning reports. While I am no Microsoft or Apple, I am not required to disclose my earnings I do. As smaller companies its necessary to keep the vultures away and as long as you show not necessarily millions in the coffers, customers like to see things like growth and seeing that you are as healthy as a small company can be. But I know you wont do that but some helpful advice from one small company to another.

Now, you do realize that to get out of bankruptcy you have 2 major BIG things to do.

1. Formulate a plan. It has to be a good plan and nothing fly by night.

2. You have to have SOME money. because in bankruptcy you have to retain some employees through weekly or monthly contracts and you have to PAY. The mediator that they assigned Bert Dehandschutter thats his job to make sure you do and you stay in accordance with laws.

So Hyperion isn't bankrupt and is in the process of attempting to have the initial court decision thrown out.

Obviously there is a story here, but no what some people were thinking/suggesting.

Good work? Acquiring the rights to develop/sell OS4 then (don't) pay contractors to do all the work. Yeah its that kind of good work that keeps loss making banks give millions in bonuses to their executives.
