Yeah, certainly not enough copies to make it a worthwhile business venture. Most Vampire users already have copies or they'll use ApolloOS so Hyperion is going to waste about $10 on all those blank floppies needed to make their "official" duplicates.

I don't speak for Hyperion alone but from my perspective we have constructive relationships with A-EON, Individual Computers and the vast majority of Amiga dealers out there like Amiga On The Lake.

I have not seen any intent or attempt to destroy any of the remaining companies in the Amiga community which would always entail wasted time and money and for what benefit? Hyperion is not a hardware producer.

Hyperion's focus is the continued development of AmigaOS IMHO.

Sometimes and I can speak from the perspective as a litigator with 20 years of experience, you are forced into protecting your IP because of unwarranted actions from third parties like a "cease and desist" and take down order of products that you sell and have sold since many years.

When that happens and no attempt at prior communication was initiated before that happened, things can escalate but that is unavoidable if third parties interfer with your business. These things have a way of working themselves out.

All I can say is that I see development still going forward with steady sales of the Cyrus boards (Amiga X5000) and the soon to be released Tabor boards.

Never since 2001 when the great adventure of AmigaOS 4.x was started, has hardware been so readily available or have there been such tangible prospects for hardware products, be it for the Classic or the PPC based Amiga's.

Enjoy and don't focus on the negative elements!

I'm sorry but I invite you to re-read the settlement agreement which was entered into the court record of the federal court of the Western District of Washington State.

The actual settlement agreement is Annex 1 of the stipulated judgment.

Our main goal going into these negotiations with the Amiga Parties was and always has been to free the exclusive license Hyperion held from ANY restrictions including those related to a certain CPU archiecture, be it 68K or PPC.

We accomplished that goal. We freed the AmigaOS from nearly all restrictions.

And with respect to H&P: I certainly do not blame them for releasing AmigaOS 3.9 even without a formal contract with Amiga Inc. Amiga Inc. was impossible to negotiate with which why we ended up in court.

H&P got out and passed the torch on to Hyperion before turning the lights off as far as its involvement in the Amiga market was concerned.

We always had excellent relations with H&P, visited their offices on many occassions, had dinner with Jürgen and his developers etc. after every show we attended. It is sad that they are no longer around anymore, at least not in the Amiga market.

Well, I doubt my memory is faulty. The contract for 3.9 was never signed by Amiga Inc. (according to McEwen and Reed Smith) but who cares? No doubt oral commiment was given by Amiga Inc. and they did not follow up on it trying to squeeze some extra money out of H&P.

Amiga Inc. was impossible to deal with.

I do not blame H&P for releasing AmigaOS 3.9 under these circumstances of being held hostage but guys, this was back in 2000. All water under the bridge now especially now that McEwen is gone (according to his LinkedIn profile).

Well, Amiga.Inc hosted OS3.9 BB1 on their amiga.com website along with plenty of other materials. I really doubt they saw OS3.9 as illegal release...

Hey, I'm not even in Ben's corner, but he did explain to you that they weren't limited to PPCs, right?
As the only company licensed to develop future variants of AmigaOS based on OS3.1, who else would develop the OS?

Did Cloanto's license ever grant them the right to modify the source code (or even give them access to the source code)?

From the discussions Apollo OS seems like a grey area legally! No wonder Hyperion have woken up to this if in fact it is the Apollo Team they are targeting rather than Cloanto.

And specifically what in those 4 pages supports what you are hinting at?

I also don't get "targetting". Hyperion's IP is in jeopardy. THAT'S what the Hyperion filings are about.
Sorry if I had to word that stronger than Ben did, but apparently that's necessary.
It's not a statement about who's right...or what's best for the community...it's just a statement.

'Grey area'? As 3.9 is based on 3.1 code, there doesn't seem to be anything grey about it.
The Apollo team is inviting a lawsuit with this.

They could have stuck with AROS 68K, but no, they had to fire a shot across the bow of the most litigious company in the Amiga community.

ApolloOS is NOT endorsed nor distributed by the Apollo Team. It's a modified/customized version of OS 3.9 put together by a person who frequents the Apollo forums who thought it would be nice to share with other Vampire owners. Folks just started calling it ApolloOS to differentiate it from vanilla OS 3.x

Most Vampire owners already own legal copies of OS3.x so stop all this armchair lawyer bullsh@t.
