Good for Hyperion, after this long running saga I hope we will now see some more progress being made to Amiga OS, especially the long neglected Amiga OS 3.x platform which seems to be the biggest group among enthusiasts, the progress developers have made here in the last couple of years has been impressive and I'm sure well received in the community.

My beloved Amiga 1200 that has been waiting for so long for a rest is thirty years old this year. Throughout those years I have lived in hope that one day I would be able to give her that rest and be treated with a new Amiga. Beyond hope I guess in my lifetime, but we keep that little flicker of a flame burning, just in case. So good news I sense. Just hope that's the end of the arguments.

It was not "leaked" - Ben posted a notice to the MLs with the attached PDF of the judgement. The judgement is in the public domain, anyone can access it.

No need to wonder, since it's spelled out clearly in the docs. First they must finish dealing with the current case you are discussing. Then:

This judgement doesn't solve anything. You could actually describe it as a win for Ben Hermans - since his only real goal is to make Mike Battilana bleed as much money as possible, in the hopes he might eventually give up and walk away. Five years of litigation with zero issues resolved certainly is a good thing (for Ben) in this regard.

For the rest of us, this case solved absolutely nothing. The judge simply told everybody that C-A Acquisition/Amiga Corporation are the ones who need to litigate the issues in question, everybody else just wasted five years.

AmigaOS 4 got buried by Ben long before this litigation started. It can't be milked anymore, so he switched to AmigaOS 3.

Bloodsucking lawyers win everytime! But hey this was likely since the only way to stop a Hyperion victory for sure was to cut off their revenue source! No Trevor bail out and no AmigaOS 3.x sales and maybe they'd settle on favourable terms! I gave up waiting for this and bought OS 3.2.1 recently (up and running the weekend 3.2.2 came out)!

My bad too along with A-EON and Amiga Inc for allowing them to snatch the keys to the kingdom in the first place! At least they allow the AmigaOS 3.x developers to push the envelope! I like OS 3.2.1 and I haven't taken the wrapper off Amiga Forever yet! That says a lot in regards to the products that we a the remaining Amiga users actually value! Hyperion do deliver (other than Worms Armageddon).

Hyperion can work on AmigaOS3.x until new case so I wish Hyperion that its incarnation of AmigaOS 3.x will one day be as good as AmigaOS 3.9.

I can vouch that with BestClassicWB it's pretty much there but without the TCP/IP stack of OS3.9 and with a slightly less feature rich Dock IMHO! The ability to mount ADFs however pushes it beyond in some ways! It is also a lot easier to install than all the Boing Bags associated with OS3.9 especially if you just buy it pre-configured on a CF/SD card!

You mean that the court case will start again? Or do you mean the legacy of the Amiga itself will now reboot with Hyperion as AmigaOS's unchallenged custodian? Unclear!

Not that I'm on their side but AmigaOS 3.2 is more interesting than the 3.X 'bug fix' of 3.1 that Cloanto released IMHO! Yes they didn't pay the developers but they seem to just like tinkering with the source code in their spare time so no harm no foul I guess?

That's no sane way to run a business IMO... while you talk on the bugfix of Cloanto, they surely didn't step on anyone's toes, and now that they actually are the owners of the damn thing you see Hyperion doing precisely that.

H&P didn't license bits of OS3.9 properly for future use. Hyperion have 'allowed' the reimplimentation of the 'lost' features and easy purchase/usage by the users in OS3.2. Beyond that, Cloanto licensed RGL's THEA500 Mini the Amiga Roms. Other than those two products it's been a desert of suitable 'official' products IMHO! Long live the PiStorm32 and Emu68!

Few questions

I don't get, why was the lawsuit allowed to go on for so long to reach this conclusion? if the wrong company was suing and had no bases to sue?

Could Hyperion counter sue for damages this lawsuit has done?

Can C-A Acquisition/Amiga Corporation just start this all over again?

Does this allow Hyperion to license out the 3.1 Roms to third parties like Cloanto / C-A Acquisition/Amiga Corporation is doing?

And Should I stop eating popcorn, or get some bag ready for the next mess?
