Jaime posted here defending Amiga, Inc. and saying the settlement delays were Hyperion's doing from his view. I think that was back in July or so.

Since it sounds like they did not even have the sources for that it would seem to hardly matter in real world terms IMHO.

That is indeed a bit strange. I think it's about time they'll release the kickstart rom(images) for free though. Can't be much value in them anymore especially not 1.3.

Hyperion and Amiga, Inc. both had access to the 3.1 sources, AFAIK. Its only 3.5 and 3.9 that they didn't have access to (haage and partner wouldn't let them have it). Certainly Hyperion have the 3.1 sources, they were used in the development of 4.x.

So "Amiga OS" has been saved now, I hope somehow the name "Amiga" gets saved too. That's indeed great news.

I suspect cloanto would disagree with that. What do you AmigaForever runs on? Emulator yes, but you need the legal set of ROMS that come with it.

It does matter because Cloanto has licensed Kickstart ROMs from AI. It also matters if someone starts making OS3 updates (the agreement does not seem to exclude this albeit seeing OS3 updates is unlikely) and the sources are available via various Amiga developers if needed (i.e. just ask ex-H&P developers).

By the way does cloanto has indefinite license to those kick roms, or is there an expiration date for that deal?

I think it's perfectly clear from this text that "Hyperion is granted an exclusive, perpetual, worldwide right to AmigaOS 3.1". If they are granted an exclusive, perpetual, worldwide right to AmigaOS 3.1, it means that nobody else has the rights to it. The part which follows is the reason why they are granted this right, e.g. "in order to use, develop, modify, commercialize, distribute and market AmigaOS 4.x", since AmigaOS 4.x contains parts of AmigaOS 3.1.

Indeed, which brings me to Cloanto's position: they're releasing 3.1 with Amiga forever, what will happen now

I dont think so. Because there is "in order to use, develop, modify, commercialize, distribute and market AmigaOS 4.x (and subsequent versions of AmigaOS ...)" but there is no "in order to use, develop, modify, commercialize, distribute and market AmigaOS 3.x (and subsequent versions of AmigaOS ...)".

There seem to be 3.x/4.x barrier. It would make sense due to other difficulties (i.e. Cloanto).

Ok so Cloanto should keep the right for emu purposes (unless there is an expiration date) and Hyperion has exclusive rights to use them for further AmigaOS developments (including 5.0), good enough...

I have no idea. But Cloanto is probably secured because I dont think Hyperion would want to p*ss them off. I guess official speakers will explain it soon.

I'm not a lawyer, so only speculating ...

Cloanto's Amiga Forever serves an entirely different market than OS4.x

Since Cloanto had legal access to the 3.1 ROMs and Workbench 3.1 before, I would imagine that this will continue. As far as I know, they did not make any changes to the ROM files or Workbench 3.1 itself.

If the settlement affects Amiga Forever it will also affect every other Amiga emulator out there, including E-UAE and the AmigaOS4PPC version of E-UAE.
